The Minneapolis Star Tribune reports that the Eighth Circuit Court of Appeals refused to review their decision to toss out Jimmy Janos’ monetary award from the Chris Kyle estate in the “Scruff Face” case;
The ruling rejected a request that the entire 10-judge Appeals Court rehear the case. It also rejected a request by Ventura’s attorney to have the three-judge appeals panel that initially ruled against Ventura rehear the decision.
The three-judge panel ruled in June that the jury improperly awarded Ventura $1.3 million for “unjust enrichment,” concluding it was a misapplication of Minnesota law.
The jury also awarded Ventura $500,000 for defamation, but the Eighth Circuit voided that award because it said his attorney, David B. Olsen, made improper statements at trial and in his closing argument.

All he has received so far is a stack of attorney’s fees bills that he has likely paid out of pocket, at an hourly rate probably in excess of $300.00 per hour, plus court and litigation costs in the tens of thousands of dollars.
As someone who generated those bills for over 21 years, you would be amazed a how much protracted litigation costs. I have worked on cases where the fee bills dwarfed the amounts awarded by the jury.

Think in the above it says immediately after that the $500K was also voided due to statements from his attorney (I think what they mean by their phrasing is ‘his attorney lied’)

It is highly unlikely any attorney would take a defamation case in this country on a strictly contingent fee basis. In 36 years, I never heard of a contingent fee straight defamation case. Most plaintiff’s attorneys refuse to take defamation cases unless they are extremely strong cases of liability with substantial provable damages. Most attorneys don’t want to bet their time and money on the value of somebody else’s reputation. I would never bet mine on Jimmy’s.
