The freedom of speech does not extend to include defaming the prophet of Islam, the European Court of Human rights ruled Thursday.
The Strasbourg-based ECHR ruled that insulting Islamic prophet Muhammad “goes beyond the permissible limits of an objective debate” and “could stir up prejudice and put at risk religious peace.”
The court’s decision comes after it rejected an Austrian woman’s claim that her previous conviction for calling Muhammad a pedophile, due to his marriage to a 6-year-old girl, violated her freedom of speech.The ECHR ruled Austrian courts had “carefully balanced her right to freedom of expression with the right of others to have their religious feelings protected.”
The woman, in her late 40s and identified only as E.S., claimed during two public seminars in 2009 that Muhammad’s marriage to a young girl was akin to “pedophilia.”
According to Islamic tradition, the marriage between Muhammad and a 6-year-old girl was consummated when she was 9 years old and he was about 50.
The Austrian woman stated in her seminars that Muhammad “liked to do it with children” and “… A 56-year-old and a 6-year-old? … What do we call it, if it is not pedophilia?”
A Vienna court convicted her in 2011 of disparaging religious doctrines, ordering her to pay a $547 fine, plus legal costs. The ruling was later upheld by an Austrian appeals court.
The woman argued her comments fell within her right of freedom of expression and that religious groups must tolerate criticism. She also argued her comments were intended to contribute to public debate and not designed to defame Muhammad.
The ECHR said the Austrian court’s decision “served the legitimate aim of preserving religious peace.”
The court also said the woman’s comments were not objective, failed to provide historical background and had no intention of promoting public debate.

The court’s rulings are supreme and supplant a nation’s constitutional provisions and that nation’s court rulings which conflict with the pronouncements of the European Court of Human Rights. It is not, it comes from the girl who claimed it, but it is said it is unclear how old she really was – may have been 7, may have been 17. So this is not as firm a fact as I had always thought. Europe has a very different view of free speech. I am not defending them. Just pointing out that their history is different.
During much of European history religious factionalism and tribalism lead to conflict and even civil society consuming wars. Some spreading through much of Europe.
The problem with conflicts born for dosagreements in religious beliefs is there is no way through reason and rational discourse to resolve often completely faith based beliefs. So Europe has good reason to try to prevent the spread of religiously motivated speech intended to be critical of different religious groups. Europe knows once that starts there is no rational resolution to the disagreement through discourse and it may lead to conflict.
The US on the other hand has a tradition of conflict of ideas, not religion, we were born from the spread of rational discourse concerning ideas of democracy, representation, and modern conceptions of government. Thus we value a conflict of ideas as being foundationally healthy for creating a prosperous civil society.
It is interesting that Americans are beginning to hold ideological views with the same fervor and faith based certitude that many hold for religious beliefs. So we too may find ourselves in a place where rational discourse no longer resolved disagreements.
Our First Amendment protects as from the government imposing consequences for our protected speech. However, it is no shield from other citizens imposing consequences. I am concerned that these consequences are potentially becoming more violent.
It is also not just speech critical of Islam that is regarded as not protected speech. Speech critical of Protestantism, Catholicism, Judaism, Hinduism and every other recognized religion in Europe is also not protected speech.
Given the history of conflicts between Protestants and Catholics, or hate and pogroms targeting Jews it is no surprise that European courts do not regard the kinds of speech that foster religious conflict as protected speech.
Fundamentally, when ideology and faith are compared, there is little difference.

There are two major problems with what you laid out. First, this is only the latest case of European suppression of speech so that whole business about religion and faith as being irrational and ripe for conflict and potential violence really explains nothing. The same can be said about non-religious views that are suppressed by gov’ts in Europe. Remember English historian David Irving, the nut job? He denied the Holocaust and, 17 years after the fact, returned to Austria and was arrested, tried, convicted, and imprisoned. For what? Denying the Holocaust. Second, I have to ask how that conflict resolution worked out in the US in 1861.

One other thing. Your first line, “Europe has a very different view of free speech” is wrong. It can be made correct if you strike the word free from it. What Europe has is gov’t-approved speech. Europeans who have been arrested and jailed for saying things that offend others, saying things that are contrary to fact, and saying things that hurt others’ feelings would no doubt find your statement to be objectionable.
One last other thing, as a pre-emptive, anticipatory rebuttal. Years ago, when SV Case #1 was being heard by the Supreme Court, I predicted that the law would be struck and that bald speech, even false speech, is protected speech. I also offered that if there was some taking, some tangible benefit derived from SV, that there would have been a different result. And, funny thing, that’s how things turned out. The answer to false speech is not suppression but truth. The answer to valor thieves is public shaming.
