  • Part II: Wittgenfeldian Legal Logic: Epic Fail (nascent Criminal charges)

    Another of Wittgenfeld’s favorite tactics is threatening criminal “procecution” which his VA Mental Health Counselor is alleged to tell him is a grand idea. Of course Wittgenfeld would first have to get Law Enforcement to pursue that, and they won’t. But let’s assume for a few moments that law enforcement in Indiana, West Virginia, Florida or anywhere else were to take Wittgenfeld’s phone call, and be all fired up about criminal charges based on any of the statutes that Wittgenfeld hurls out there like a monkey flinging excrement. Would any of those be valid?

    Of course not. But let’s look at them anyway, because some folks don’t know the law, and might actually feel threatened enough not to comment etc.

    For the remainder of this, I will be assuming that both comments from Wittgenfeld on this blog (which are all linked to his known IP address 184.90.245.118 from which he sends emails) and the postings on his blog with Arthur South (which contain the same faulty legal logic as each other) are all Wittgenfeld. It may be that South wrote some of the stuff on the blog, but we know they are in this conspiracy together because of the date/time stamps on the comments which mirror each other. For instance, in citing to law regarding harassment and cyber laws, both the blog and the comments cite to Virginia law (where no one lives) within minutes of each other, despite each separately noting that all states have virtually the same laws. That’s too random to be truly random.

    A perfect illustration of the Lilliputian legal mind of Wittgenfeld is found in just this recent threat:

    Further, he alleges that part of this conspiracy includes his mental health practioner at the VA:

    like how you dingleberrys try to poooo poooo the VA Medical Chief’s legal advise [sic]. That is funny because who ever goes down on here will be doomed by her legitamate [sic] findings, legal report, and recommendations to the procecuter [sic]. Done deal.
    Yes your names and pictures identifying most of you are in her paper file too. She does have access to any VA Computer she wants… And she wants to see all of you in jail. Got that picture yet..?

    Now, I don’t for a second think that the “VA Medical Chief” is actually engaged in giving out legal advice (or “advise” if you are Wittgenfeld) without a license, nor does she have access to my records, since that would violate HIPPA since I am not seeking medical advice (or advise for that matter) from the VA. Notwithstanding that, it is idiotic on a Brobdingnagian level to have asserted that. (Yes, “Lilliputian” and “Brobdingnagian” in one post, sue me for “harassment”.)

    For more specific threats, I liked this comment:

    Soooo, Hey Lilyea..? When the West Virginia State Police call you on that phone number….. Who will they be discussing your charges with..? Your wife. Your boyfriend. Maybe give me the right number… You too Scotty, we will have a conference call. It is possible for me to serve you all the paperwork myself. Personally. That’s how I like it…

    Again, for some unexplainable reason, Wittgenfeld thinks he can do criminal charges by himself. Note that above he is telling people to “arrest” us, which would essentially be kidnapping, and here he is saying he is authorized to “serve [us] all the paperwork [himself].” To suggest such is to misinterpret how the legal system works to a degree that it makes me question his sanity. The only one authorized to do such a thing would be law enforcement, unless Dallas here thinks he has leave to do “citizens arrests” which would make him culpable for any number of legal remedies. But, if he wants to do something so neolithically idiotic, who am I to discourage him.

    Lastly, he bolsters his argument with one of the more insane ramblings I’ve ever seen on the intertubes, a posting entitled: CYBER-STALKING: YES, IT IS A CRIME.

    In that Magnum Opus to mental midgetry, the South/Wittgenfeld protagonist (here forward shortened to WittgenfeldSouthEtAl) claims that:

    “Hunters/slayer” on Facebook and in independent blogs have been systematically growing ever more nasty in their actions. Falsely claiming 1st Amendment rights as their permissive adjunct to do what they do. In fact 1st Amendment rights are not involved one bit when doing what they do. It is illegal in all 50 states and on an international line as well. All of the states have similarly written statutes concerning Cyber-stalking. Definitions are equal and across the board totally illegal to not only practice but to be involved in, in any way.

    Although individually everything written there is done so in English, the words together make no sense. Absent a Medium with some sort of Ouija board or some other means of divination, it is my sad task to try to unbundle it. He continues in this rambling manner for quite a while before taking the fight not only to your humble bloggers, but also commenters and readers of the blog:

    This is basically a warning to those Cyber-stalkers who we have dealt with in the past, this is no longer some back and forth game to laugh and enjoy yourselves at others expense. We are in the process ( in conjunction with 3 lawsuits now in play) of filing charges against these criminals.

    Once again Wittgenfeld cloaks himself in some invisible cloak of legal authority in claiming that he is in the process of “filing charges against these criminals.” No, he isn’t. Charges don’t come from private citizens, they come from prosecutors, grand juries etc. Unless he is now claiming to be part of some ridiculous “sovereign citizen” movement with ploys like those used by Code Pink to “arrest” Karl Rove, there is no such movement afoot. It’s just South, the incarcerated Ray Hall, Bob Golden and Chief Dunce Wittgenfeld of the Supreme Court of Imbecility spouting nonsense on the web again.

    Now, remember where I said it was impossible to tell if the blogger here and Wittgenfeld are two different people or just the two minds of Wittgenfeld’s? (One mind is lost, the other is out looking for it.) Well, compare his inability on comments to tell the difference between “advice” and “advise” and read this bit of masturbatory legal fantasy:

    Our advise [sic] ( take it or ignore it) is to remove your comments, unlike posts or comments related to this breach in the law; possibly even distancing yourself from those who are on the verge of facing criminal charges. Just a warning. It’s up to you to make the choice, personally we hope you ignore this warning and continue to associate yourself with those who will very shortly feel the long arm of the law.

  • Wittgenfeldian Legal Logic: Epic Fail (nascent Civil complaint)

    As most of you have seen, Wittgenfeld continues his Jihad on logic and the law by threatening not only Jonn and I, but also commenters.  It’s all asinine, and he is using legal threats to either bump up his comment count (see for example comments like “My goal is 600 or more comments by you jack-offs.”) or, alternatively, to cow people into not commenting.  Like everything else dealing with Wittgenfeld, it doesn’t make any sense.

    I’m going to look at both the Civil and Criminal claims of Wittgenfeld, and lay them out so you can relax about all his threats.

    Here’s a perfect example of Wittgenfeldian logic:

    I have proof that you idiots right here came onto my facebook [sic] and stole this picture hereon [sic] from my wife… A year ago Scooty [sic] and his gang via Lilyea and Seavey and off to POWnetwork…. Links up pretty good, I think [sic]

    Now, that is only slightly ironic, given that this jackass steals stuff from my friends and family on a weekly basis, and then posts it up.  Just how ridiculous is Wittgenfeld?  A few weeks ago he made another flier about my perfidy by stealing pictures from my Facebook page.  Only, the moron stole pictures of The Sniper and Ponsdorf, and mistakenly labeled them as me.

    Just yesterday Wittgenfeld stole a picture of me and Uncle Jimbo, which is probably still up on his Facebook page.

    Nonetheless, his latest bit of idiocy is to conflate civil and criminal law, and make perplexing statements like “We will all go to jail…. are you ready…?”

  • TSO off to Africa

    First, some background info.  If you get the Marine Corps Times, you can read an article in the August 13th issue about what we have going on there, but for everyone else, you get an outdated story that seems like the mission is the same…

    TOUBAKOUTA, Senegal, Apr 25, 2011 — The Marines of second platoon, Ground Combat Element, Security Cooperation Task Force (SCTF), Africa Partnership Station 2011 recently kicked off the Senegal chapter of APS-11’s military-to-military exchanges along the west African coast. Africa Partnership Station 2011 is a U.S. Africa Command maritime security assistance program that is designed to strengthen participating nations’ maritime security capacity through multilateral collaboration and cross-border cooperation. Marine Corps Forces, Africa is supporting APS-11 with a SCTF based out of Camp Lejeune, N.C.

     Amid countless miles of cashew trees, savannah brush and barren Senegal desert, and together with about 100 Senegalese Commandos and Nigerian Navy Special Boat Service troops, the 45-man platoon is welcoming the close of a rigorous first week of training just outside of town here. As the training regimen picks up pace, it’s apparent to the Marines that cooperation is imperative to the success of the partnership, and is easily achieved even in a culture as different as Senegal’s.

    “It’s interesting to see how quickly the Senegalese learn the material despite a language barrier,” said Corporal Steven Bray, an armorer attached to second platoon. “It also helps that when we’re not training, we’re still together. We’re trying their food and they’re trying ours, we talk to each other in the evenings and we train with one another all day. It makes for a great partnership,” he added.

    Now, the background on my involvement comes from the July issue of The American Legion Magazine.  I got 5 complaints about that article, and a ton of good comments.  The bad comments amounted to one (now former) Legionnaire who complained that one of the guys on the cover was wearing a National Guard patch, and according to him “Those damn Guardsmen have been getting people killed since Korea, and I won’t be with any organization which supports them.”  No sense arguing with him and letting him know I was a former Guardsman, I doubt it would have done any good.  The other 4 complaints centered on my “Army-centric” stories; people rightly suggested that I spend time with other services as well.

    Fair enough complaint.  I do tend to spend more time in my Army comfort zone if mainly because I understand the organization and lingo better.  But, the complaints allowed me to approach my Editor who authorized 4 more world-wide trips to do articles for the magazine, covering the USMC, the Navy, Air Force and Coast Guard.  This trip is the culmination of my USMC search. 

    To answer a question I have been getting a lot: I have no idea what I will write about, since I tend to go and then figure out what is interesting, rather than coming up with a topic and looking into it.  Essentially though, I suspect it will be something about the military exerting soft power in Africa, as opposed to hard power or direct military action.  Doing counter-narcotics and training the local forces is a good way to build rapport up front, and possibly guide the African forces before we need to work with them if there is some sort of incursion of “bad guys.”

    And there does appear to be a distinct possibility that Senegal might be problematic down the road.  There is a separatist movement in the South that seeks independance for the Casamance Region.

    Suspected rebels on Friday killed a Senegalese soldier and wounded four others in the restive southern   province of Casamance, military sources said.

    The soldiers were attacked as they came upon rebels “who were in the process of committing a hold-up” north of Casamance’s main city Zinguinchor, and in the ensuing firefight “we recorded one death and four injuries,” an officer said.

    Anyway, I am not actually going to that area, but will be further north, above Gambia. 

    So, that’s the situation.  There is a fairly good chance that I won’t be blogging for the next two weeks starting this weekend.  I’m leaving this weekend (after my 2nd Anniversary) and get back around the 23rd.  There’s a possibility I will have internet access there, but I honestly have no idea.  As soon as I know, you will know.

    If my iPhone works over there, I will be updating my Facebook page at least.

    I haven’t compiled all the numbers yet, since I am busy at work, but I can tell you that it wasn’t even close. Diliberto never won a day with less than 60%. He’s a special kind of dirtbag, and a worthy recipient of our award. At some point this week I will do a follow up, and maybe provide some contact info for the Veterans for Rethinking Afghanistan so they can explain to us how they have a man working for them who has continually lied about having served in the theater that they are ostensibly focused on.
