
ETCS (SW/AW) (Ret) sends us a link to the UK’s Daily Mail about Floridaman, Jesus Esquivel who shot and killed a AAA service technician who didn’t arrive on the scene in a time period that was acceptable to Floridaman;
Esquivel, a disabled Navy SEAL veteran, got into an argument over the phone with a service technician about the length of time it would take for him to get a new car battery for his 2003 Cadillac Escalade, the arrest report says.
He threatened the driver, who then asked his bosses to have another driver sent to Esquivel’s house.
The company dispatched [Magdiel Hernandez, 38], who had worked for the organization for ten years, according to his family.
When Hernandez arrived at the home south of Miami, Esquivel opened fire, hitting him several times in the torso, according to police.

Countless SEAL Imposters show proof of their SEAL claims in the form of SEAL Insignia (Tridents), SEAL Coins, SEAL Award Citations, and SEAL Training Graduation certificates which are unfortunately all available on-line. Numerous others get SEAL Tattoos, Photoshop their faces on SEAL Pictures and alter actual Military Discharge Papers to show SEAL service. Myriads of imposters claim the Navy removed their name from the SEAL Database when they encountered trouble during their service and nothing could be further from the truth.
Many SEAL imposters when confronted with the information I have provided will resort to claiming that their records are sealed, burned or their SEAL Operations were classified as Secret and that there are no official records of them. Before any classified operations may be undertaken as a SEAL Operator, a man must first successfully complete the Basic Underwater Demolition/SEAL (BUD/S) Training program and then the follow-on secondary training program. The names of all those who successfully graduate from that training program sequence are compiled in the SEAL database. Later participation in classified operations has “NO IMPACT” on whether or not a person is listed as a graduate of the training program.
There are records of every man who has qualified for the title of “SEAL”; there have been and will continue to be secret missions, but there are NO secret SEALs.
When discovering that a person was never a SEAL, many people would like know what that person actually did in the military or did he serve at all. WSVN is calling him a “a disabled Navy veteran” so the SEAL thing may just be a miscommunication in the media. Either way, he’s not a SEAL.

It doesn’t work that way. The special people get the high value targets, the really bad guys, the high profile enemy cells.
When a mission comes up, the special dudes get first picks, and we get the left overs. Sometimes there are so much shit going on that we get a piece of the pie while doing a terrain denial patrol or simple moving to contact mission, trying to convince hajj that is ok to come out and play with us.
And yeah, I have done a shitload of missions and got shot at in anger, but not for a moment, I am going to embellish my service and pretend all units are the same.
And if you don’t like it, pour some sugar on it or man up and go through selection and join the special dudes.
There is a pecking order, and our units are tools to be used by higher command to solve problems.
A commander that send the least trained unit to do the hardest job is a poor excuse for a leader and needs to find another job or become a politician.

If he’s properly prosecuted he’ll do life sans parole at the least. Florida has the 10/20/Life Law saying that if you pull a firearm during the commission of a crime it’s an automatic 10 years. Fire said weapon and it’s an automatic 20, kill someone and it’s a mandatory Life Sentence. Regardless, he’ll have plenty of smooch time with Bubba, Thor and his cell block.

I swear I’ve covered this before on this blog, but here it goes again.
Every paper (publication, really) in the country uses what is called a “style guide.” It explains to writers what the standards are for that organization, such as when to use numerals vs. spelled-out numbers, when to capitalize certain words, and so on. One is expected to write using that particular set of standards.
Most small organizations don’t develop their own guides, but adopt a 3rd-party guide. Examples would be the AP Stylebook and the Chicago Manual of Style.
In this case virtually every style guide I’ve ever seen instructs writers to refer to someone who hasn’t been convicted of a crime as an alleged perpetrator. It’s just that simple. No political agenda at all.
While the Daily Mail might have done a little digging on this, note that they’re working from an AP feed from another country. I doubt a paper in the UK has much time or resources to verify every store they chose to publish from another country. Apparently AP got the story from Channel 7 News (WSVN)” in Fort Lauderdale. Oddly enough that story only called Esquivel a “disabled Navy veteran,” with no mention of SEALs. Another source cited by the Daily Mail was this Miami Herald article which only said that the shooter “told workers he’s a former Navy SEAL.” Note neither reporter claimed the shooter was a SEAL. That apparently was something the Mail inferred. From my own experience someone probably went for a concise description, so someone “tell[ing] workers he’s a former Navy SEAL” got shortened to “former Navy SEAL.” I’ll have to take back my earlier remark and say that the Mail stepped on their dick a bit by making that editorial decision.
But sorry, no, no nefarious plot here. Just a)someone following standard reporting style guides which require one to refer to un-convicted perps as “alleged” something or other (shooter, assaulter, etc), and b) a lazy editing decision.
I don’t doubt there are reporters out there with an agenda, but the two US papers in this case didn’t cross any lines. The single British paper made a claim they shouldn’t have, but it should be self-evident that malice was lacking.

Maybe a TAH legal beagle can ‘splain this to those of us on the short bus. According to the Daily Mail story, Jesus Esquivel is currently being held in the Miami-Dade Jail on a charge of second-degree murder. If you consider the circumstances, Esquivel allegedly got into a phone argument with AAA, then fired multiple rounds at Hernandez once he was barely out of the truck on the service call.
Meaning, apparently, that Esquivel walked out of his house with a loaded weapon, and a predisposed intent to shoot the AAA guy. This would seem to point to premeditation, first-degree murder, and capital punishment. Evidently Under Florida law, if Esquivel has any past felony conviction, it would also add an extra argument for the death penalty.
So why is he sitting in the slammer with a second-degree murder beef which could potentially be plea bargained down to manslaughter?
Non-lawyer wild guess? They cant (yet) -prove- he plannned the attack, versus just raging on the first thing he happened to see in the driveway.
Once they have further evidence, they may add charges later.
Just a guess but 1st degree murder is what is called a “specific intent” crime while 2nd degree murder is a “general intent” crime.
“Specific intent” means that the defendant intended the result, while “general intent” just means he intended the action.
If I read the account correctly, Esquivel fired through the door, not necessarily knowing where the victim was standing or even whether he would hit him. He just fired in blind anger. That makes it second degree because you can’t prove that Esquivel intended to cause someone’s death.
But he did act with “depraved indifference” (One of my favorite legal terms, BTW) in firing through the door.
As the old lawyer’s saying goes, “It’s not what you know, it’s what you can PROVE.” It would be tougher for a prosecutor to prove that Esquivel intended to kill someone but proving that he fired through the door when he knew or should have known someone was there would be much easier to prove.
It could also be an issue of judicial economy. It may be that unless they’re seeking the death penalty the punishment for 1st and 2nd degree is life without the possibility of parole. So if that’s the case, why waste the taxpayers money trying to prove an element of the crime (Esquivel’s specific intent) and risk an acquittal or mistrial when the sentence will be the same either way?
If the prosecutor wanted to file charges to ensure Esquivel is held in jail without bond, he can do so by filing 2nd degree murder charges. The prosecutor can file 1st degree murder charges later if the evidence supports it.
Couldn’t fix his own car? Definitely not a navy seal, esquivel is just another case of Cuban arrogance, a marielo gusano, trained in the streets of Cuba, and as must Cubans think they own the hostile city of Miami, and can shoot anybody at will…Magdiel was my friend from childhood and no man deserves to die like this…I am sure a navy seal wouldn’t have done that…God bless America
