  • Virginia District Court finds Stolen Valor Act Constitutional

    District Judge James Jones, ruling in the Western District of Virginia, Big Stone Gap Division ruled that the SVA is in fact constitutional. In a concise ruling, he found:

    Preventing individuals from wearing honors they did not earn furthers a substantial government interest in honoring specified members of the military and preserving the respect and novelty of legitimate military decorations. The statute’s purpose is not related to the suppression of free speech, and incidental restrictions on freedom are no greater than is essential for the furtherance of that purpose.

    The story of Ronnie L. Robbins is like so many before it:

    [The Indictment] alleges that Robbins served in the United States Army on active duty from 1972 to 1975, but did not serve overseas or in any combat capacity and was not awarded or entitled to any medals or awards related to such service.2 The Indictment charges that Robbins was a member of the Veterans of Foreign Wars (“VFW”), which requires that its members have overseas service in a foreign conflict. While running for reelection to local political office, Robbins produced and distributed campaign material that stated that he was a recipient of the Vietnam Service Medal and the Vietnam Campaign Medal. Robbins also wore the Vietnam Campaign Medal, the Vietnam Service Medal, and the Combat Infantryman’s Badge on his military uniform at events he attended as a member of the VFW honor guard. Additionally, Robbins allegedly provided falsely altered documentation to the VFW misrepresenting his military service and asserting that he had been awarded the Vietnam Service Medal and the Vietnam Campaign Medal. Finally, it is alleged that Robbins provided altered documents to a local newspaper corroborating that he had received those medals.

  • About that Mt. Soledad ruling

    First, some background via SignOn San Diego:

    The 20-year legal fight over the cross on Mount Soledad took another turn Tuesday when a federal appeals court ruled the towering landmark on public land in La Jolla is an unconstitutional sign of government favoring religion.

    The ruling by a three-judge panel of the 9th U.S. Circuit Court of Appeals was a blow to cross supporters, who have been battling efforts in state and federal courts to get the cross removed.

    For now, opponents of the cross have prevailed. They have argued the Latin cross is an impermissible religious symbol on public land. Supporters have countered it is a secular landmark amid a larger memorial that honors military veterans and has no explicit religious meaning.

    So you get the idea. I don’t want to go into everything dealing with this case, but there are a couple of things that bear looking at.

    The decision is predicated on this [Pages 207-108]:

    There is simply “no evidence . . . that the cross has been widely embraced by”— or even applied to—“non-Christians as a secular symbol of death” or of sacrifice in military service. […] It is thus unsurprising that, as the government’s expert admits, “[o]ver the course of time, Mount Soledad and its cross became a generic Christian site.” The Latin cross can, as in Flanders fields, serve as a powerful symbol f death and memorialization, but it remains a sectarian, Christian symbol.

    The court in fact asserts that:

    In light of the uncontested history submitted by Jewish War Veterans, the few memorials cited by Linenthal provide less than a scintilla of evidence to support his conclusion that the Latin cross serves as a non-sectarian war memorial.

    I’m wondering what Justice Kennedy will think of that, since in Buono (Mojave Desert Cross case) he stated:

    But a Latin cross is not merely a reaffirmation of Christian beliefs. It is a symbol often used to honor and respect those whose heroic acts, noble contributions, and patient striving help secure an honored place in history for this Nation and its people. Here, one Latin cross in the desert evokes far more than religion. It evokes thousands of small crosses in foreign fields marking the graves of Americans who fell in battles, battles whose tragedies are compounded if the fallen are forgotten.

    In fact, the 9th Circuit here even took a direct shot at him on this issue:

    Nonetheless, we have thoroughly considered Justice Kennedy’s opinion. As we have discussed, the record before us does not establish that Latin crosses have a well-established secular meaning as universal symbols of memorialization and remembrance.

  • the Best and Worst of World of Warcraft

    Right now, I really hate WoW. I probably won’t give it up, but PISSED. The expansion came out and I played for about 18 hours a day for 3 days to make the new level cap, 85. Good stuff in the expansion etc, but my character isn’t geared to go any further. So, I figure I will go and get a good weapon, and move from there. So, I set my eyes on this little beauty:

    Thing would just be money for my Shadow Priest. So, you can get it via the new “Archeology” skill where you run around and dig shit up, and put it together.

    Well, I’ve dug up half the fahkin continent for 2 weeks now, and no staff. Dwarven Dice, diapers, some half assed mug that conjures up dancing Dwarves, I have a pet raptor and some boney raptor that I can ride around on, no staff.

    FU Blizzard, I want my damn Staff.

    However, I did hear about this story from my brother this weekend, and I think it is the best thing I’ve ever heard.

    Apparently there was this nice lady who played a Horde character, and achieved Officer status in her guild. She loved the snow, and fishing. She played on a Player v. Player server, which means you attack other players, as opposed to PVE servers where you focus on killing monsters. Anyway, this unfortunate woman had a stroke and died. But her guild decided it would be nice to have a funeral for her in the game, and so they went up to this area she liked to fish in. They all lined up and had a parade in her honor.

    That’s when a bunch of other dudes came out of the woods and slaughtered every single player at the funeral. As stated at Games Radar:

    This is where things got out of hand. Once Alliance guild Serenity Now got word of the event, they decided to crash the Horde e-Funeral, earning many honorable kills for their most dishonorable attack. Some have argued that while Serenity Now’s actions can’t be described as right, they didn’t really do anything wrong. This may have been a funeral for a friend, but it was an “in-game” funeral on a PvP server where slaying players from the opposing faction is a big part of the game. In this sense, Serenity Now’s raid on the Horde funeral didn’t break any rules.

    But rules were broken on that day, social rules that fall outside the artificial boundaries of “in-game” rules. These are the same rules that separate us from savages – and they’re the reason why most of you wouldn’t gather a group of friends together to piss on a stranger’s grave at their funeral. What say you? Were Serenity Now’s actions hilarious or horrible?

    Screw social rules, that is HILARIOUS. Seriously, it is a game people, relax. If I die in game or out, I hope Dreadbeard (our own Claymore) will throw me a kicking party for a funeral. I hope this band plays there:

    No More Thrill of Victory or Agony of Defeat?

    A buddy of mine who likes to get me fired up sent me an email this weekend that seemed clearly intent on doing just that. He is the father of two young boys, both under 7, and one of the “games” they got for Christmas was something called “Snail’s Pace Race”, which according to the Company that makes the game (Ravensburger) is enjoyed thusly:

    Let’s Play! Place the colored wooden snails on their matching starting arrow. At the beginning of the game, each player chooses the color snail that they think will come in first and the one that they think will come in last. The youngest player starts by rolling the two wooden die. They then advance the snails that match the colors rolled. If they roll two of the same color, they would then move that color snail two spaces. Play continues until all of the snails have reached their color circle at the other end of the game board. Just remember to keep track of which snails were first and last. The players who chose the right snails all win! What Do You Learn? Color recognition & task completion

    Now, according to the one line in there, “[t]he players who chose the right snails all win!” one would assume that there are indeed winners and losers to the game. But my friend pointed out some of the comments to the game on Amazon.
