The military judge hearing the Bergdahl case has declined to dismiss it.
Bergdahl’s lawyers had asked for the case to be dismissed due to pre-election comments by then-candidate (now President) Donald Trump. The judge said he found the comments “disturbing”, but that they did not constitute unlawful command influence.

I’m guessing another “Rose Garden Tea Party” isn’t exactly in Bergdahl’s – or his parents’ – future any time soon.

If the President/Commander-in-Chief, told the Courts Martial board to: “Handle this like any other case, follow the regulations, and precedents, and dispense whatever justice you deem proper.” His defenders would claim that the Prez “influenced the panel”.

Mostly what I got from that ‘article’ was a frustrated effort at stopping the frakking autostart on the video.
It’s enough to make you put your fist through the internet’s left ear, and unfortunately, it covers most of the copy so that between the Googlads at the bottom and the autostart video, you have about two lines of copy.
Aside from that, Trump was not the president when he made those remarks, so they are non sequitur in my book. Whether Bergerbutt’s attorneys like it or not, they can only delay this for so long before this trial has to commence. That old ‘speedy trial’ thingy in the Constitution says so.
They can pull all the delaying tactics they want to and use all the tricks they like, but the fact IS that Bergerzass deserted his post, period. The other events that followed are pertinent to it. He’s a deserter. Everything else comes after that.
He not only deserted his post, he did so in a Combat Zone and at least six Troops were KIA from missions searching for the fleabag hippie shitass. IMHO that ought to result in at least six more Manslaughter charges against him!
A more thoughtful, disciplined candidate might have realized that it was a bad idea to talk about a pending criminal case that might fall under his responsibility in the not too distant future. That said, I know of no case that’s ever found unlawful command influence based on something a commander said before becoming a commander, so the military judge made the right call. With a well chosen panel and under the careful watch of the military judge, Bergdahl can still have a fair trial.
Oh, boo-hoo. Mr. Defense Attorney, you are welcome to become disturbed about anything you would like to be disturbed. Pardon me and a few of my closest friends while we laugh at your selection of this traitor as your client. Yes, you should indeed be disturbed, but we likely would not agree upon the source of your disturbance, one which you yourself chose.
This disturbance can not be removed soon enough. Thanks to all involved for now expediting the conclusion of this circus. The military has shown unbelievable diligence and maturity in their handling of this mess.

What is important is not what a candidate said but what a President did not do. When given a chance to issue a pardon to Bergdahl, he demurred. Bergy was Obama’s political squeaky toy. He played with him until he he was no longer useful, and then cast him off. Barry could have pardoned him with little or no fallout for himself, but he left the mess for the next administration.
Hillary can’t do it and Trump won’t. Bergdahl is so screwed, and he richly deserves it.

Not saying its what I want but I see Bergdahl getting Reduced to E-1, Forfeiture of all pay, allowances and benefits and Dishonorably discharged.
He will also be given a suspended prison sentence due to his time in captivity.

In this case, upon conviction, a proper “suspended sentence” would involve a properly tied manila rope….
Put him to sleep using Zolpidem and other sleeping pills ground in his nightly milk, then while he’s asleep, blast a round right through his damn head, that kills him. He won’t feel it. Doesn’t need to be public. Cleaning up the mess would be disgusting but easy. Cheaper to bury him after a short death then to keep him confined in prison for years.
What type of Court Martial is he getting? Don’t remember seeing or hearing which one, a Special or a General. If it’s a Special, the death penalty is not available if I remember correctly.
