Dave Hardin sends us a link to the Associated Press which reports that Jimmy Janos lost his chance to appeal to the Supreme Court so that he can reinstate his $1.8 million award in the Chris Kyle “Scruff Face” case;

The Supreme Court has turned away former Minnesota Gov. Jesse Ventura’s bid for reinstatement of a $1.8 million verdict in his defamation case against the estate of slain Navy SEAL and “American Sniper” author Chris Kyle.

The justices didn’t comment Monday in leaving intact a decision by the 8th U.S. Circuit Court of Appeals to upend the verdict.

Couldn’t happen to a nicer guy.

  3. Now, with that out of the way, can the Kyle estate counter sue for court costs, pain and suffering, mental anguish, etc, etc?
    It would warm the cockles of my heart to see that happen. hehehehe.

    1. NICE thought for the day, DBW!! I’m sure the Kyles will have a much better case against Janos than he did against them!

    2. I don’t know about the legalities, but if Mrs Kyle does sue and win, collecting on that suit might be a bit problematic. As I understand it, Janos went deeply into debt to finance his lawsuit, expecting to pay for it with his winnings.

      1. So if they did win a judgement against Janos, it would likely be akin to a judgement against Bernath.

    4. Actually, all the Supreme Court said is “we aren’t going to hear an appeal from the Eighth Circuit on this case because there is nothing in the law we have to decide.”

      The Eighth Circuit, for its part had said the judge in the case had allowed statements that should not have been allowed (who was going to pay the judgement) and then vacated the judgement and sent the case back for another trial.

      If Ventura wants a new trial, he can avail himself of that option.

      There is nothing there for the wife to sue for at this time.

    Just in case anyone wanted to see it in print in the language of the Supremes…

      In essence, the Supreme Court didn’t have 4 justices who thought that there was an issue of law in the case. They let the 8th Circuits ruling of vacating the judgement and remanding the trial back to the local level stand.

  9. The extra sweet thing about this is that no matter how many times Jimmy No Balls ask, “But why? Why did the court deny my appeal?” the answer will be the same: __________________.
    That’s frustrating, terribly frustrating. Really, really frustrating. Don’t ya just love it?

    1. If I understand it correctly, the court didn’t deny his appeal, they pretty much ignored it. Even better.

  11. I wonder whether he gets a new trial with almost all of his damages claim gutted from the case. Any of you other “lawers” know the answer to that? I don’t give a shit about that phoney bastard Janos, so I won’t waste the brain power to look it up.

    1. The Supreme Court denied certiorari (cert) to hear Ventura’s appeal of an Eighth Circuit opinion that vacated the judgement and the damages based on some improper statements by Ventura’s attorney.

      The Eighth’s order also remanded the trial back to the lower court which means that Ventura can try the case again if he so desires or let it drop.

      It should be remembered that the Supreme Court gets 7,000 – 8,000 requests to have a case heard each session. They actually hear and decides about 80 cases.

      The odds are never good on heading to the Supreme Court and especially in this case where there was no real law or Constitutional issue to rule upon.

      1. Well, since most of his damages awarded were for a measure of damages not allowed under the applicable state’s law governing defamation, I doubt his attorneys will want to retry the case unless Jimmy is going to pay the costs plus several hundreds of dollars an hour for their time. The case will now probably settle for small dollars coming from the publisher’s insurer. Janos needs to go back to ol’ Mexico and FOAD.

  12. Dislike that dickhead too but he won the trial which is how our justice system works although I thought the amount of the verdict was over the top.

    1. One reason he won at trial is because his smarmy “lawers” committed misconduct and made the improper argument that some insurance company was going to pay any judgment the jury awarded anyway, when there was no evidence to support this argument. The cases are legion that making such an argument where insurance is not an issue is reversible error. It was a transparent attempt by counsel in closing argument to appeal to the passion and prejudice of the jury.
      I also have trouble believing his already questionable reputation was damaged in any way by the “scruff face” story in the book.
      Too bad the commenters here can’t testify in any retrial about Janos’ stellar reputation among the veteran community, especially among those that know what a lying SOS and valor thief he is.

    But I do have to say that “Janos loses appeal” is almost as nice a thing to see at TAH as TSO’s cutie-pie.
