The Fourth Amendment of the US Constitution reads;
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
Basically, it says that you have the right to due process before the government can take your stuff. Well, that phony Vietnam veteran, the Senator from Connecticut, Richard Blumenthal has introduced a bill in the Senate which will abrogate that right for gun owners simply because they’re accused of violent behavior whether it’s true or not. Especially in restraining order matters;
Temporary restraining orders generally are given for a two-week period to allow time to set up a court date for the accused to defend himself or herself before a judge.
Under these proposals, firearms could be taken during that period — as opposed to current law which only allows for that to happen when someone is convicted of domestic violence or subject to a final restraining order.
Yeah, if I was intending to do harm to my neighbor, but I knew that he had a gun, all I’d have to do is go down to the local courthouse, swear out a restraining order, and then, voila, he’s disarmed.
In fact, it’s happened to me twice in the last year in retaliation for stolen valor busts here at TAH. I suspect that one restraining order was filed just so I would lose my guns so a particular mentally deficient fellow could confront me at my home. The other douche nozzle did it just to harass me. Which is easy to do, actually – you just go the courthouse, tell a tear-filled story and swear to it, whether you’re lying or not, and the order gets issued. In fact, you’re subject to the order without knowing about it.
But, yeah, who would have thought that a Valor thief would think that it’s perfectly cool to suspend Constitutional protections. The gun grabbers think it’s a great idea.

The Democrat said her bill is “perfectly consistent with due process” because it allows for the accused to defend themselves in court, even if that defense is delayed. Cheh, who is a constitutional law professor, said she has “complete confidence” that her bill would be upheld by the courts.
I have complete confidence that, if the same method was applied to abortion rights or environmental regulations, Cheh would be opposed. Only when it’s applied to gun owners does it seem reasonable. I’d be interested in seeing the statistics which would point to a need for this law. I suspect that it’s just another attempt at making people feel safer without actually doing something. And as long as it’s only those evil lawful gun owners who are sacrificing their Constitutional rights, what’s the big deal? Right?

I don’t like convenient correlations. I do not believe the IRS when they say that they have no backups. It is convenient because the IRS doesn’t have to show information that may make them look bad.
In this case it seems really convenient that the people who lose their rights rarely vote for the party proposing the change.
It is also convenient that the claim is based on an emotional response and not on numbers justifying how many people are protected by this statute.
I think that it is convenient that Jack loses his rights because Jill says he has a weapon. So the police go to Jack’s house and seize his firearms. Jack is now disarmed. I hope that Jill’s new boyfriend doesn’t show up at Jack’s house with a baseball bat – or a gun.
Suppose that Jack doesn’t have a weapon? Jill could still accuse him, the cops would still show up and they might search his house. Would you feel harassed if that happened to you? I can hear Jill’s lawyer making a big deal in court about the fact that Jack had weapons that had to be seized.
So Jack and Jill are in court, the judge is hearing Jack’s request to get his weapons back. Is that a presumption of innocence? Or is the law written so that Jill has to justify why Jack CANNOT get his weapons back? Is Jack being treated like a felon but without the “trouble” (those annoying things like proof, facts, a jury of your peers – stuff like that) of a felony conviction?
To me, this seems like very poor public policy.

I’m fighting a bogus restraining order in which my littlest sister played the pity party card for being tossed out of my moms home. Even if I do manage to get this thing quashed it stays in my permanent record….. She tried like hell to get the judge to make me turn all my firearms in but he didn’t go that far with it. The taking, if ordered, is not pursuant to an arrest and the complainant (automatically called a victim) need never allege that a threat was made or that a gun was mentioned. Otherwise, there is an chargeable offense. When the government–state, local, or federal–takes a person’s legally possessed property, it must either meet the warrant requirement or satisfy one of its exceptions. His bill will fail but it’s part of the chipping process.

And second… This is the best part, A REPUBLICAN will still hold that Senate seat come November. No chance in hell for the Democrat nominee to win.

And this is EXACTLY the problem with restraining orders.
The 5th Amendment also applies here – no person shall be deprived of their papers, possessions, or property without due process (paraphrasing)
A restraining order is done at an Ex-Parte hearing (meaning only one party is there) – the accused often (almost always) has NO IDEA there is even a hearing.
Based upon un-rebutted accusations, made without the ability to confront your accuser or the evidence (in the Bill of Rights too, right) you are kicked out of your house, and/or denied your property, and/or denied the ability to conduct your business.
All those White Knights who want to be all popular with women and be all chivalrous who have said NOTHING while this has gone on need to realize this:
Law is set by PRECEDENT – that precedent is now years old and has never had a real challenge. The law will always expand and be expanded by those with a political agenda.
