Alemar update

Thanks to 2-17 CAV for the link to the latest craptastic BS in regards to Billy Alemar who we discussed here, here and here back in August. If you remember, Alemar was stopped by Officers Fife and Pyle in Martinsburg, WV when they caught him in a “terroristic act” of training for Ranger School while wearing ballistic armor and an Airsoft rifle. Well, it seems that the prosecutor has backed off the “terroristic act” thingie according to The Journal;

William Everett Alemar, 23, of South Raleigh Street, Martinsburg, pleaded no contest to one count of public intoxication and one count of misdemeanor willful disturbance of a school.

As part of the agreement, Berkeley County Prosecuting Attorney Pamela Games-Neely agreed to dismiss felony charges of committing a terrorist act and wearing body armor in the commission of a felony.

Alemar was fined $10 and sentenced to seven days in jail with credit for time already served on the charge of willful disturbance of a school as part of the binding plea agreement. He was fined $5 on the charge of willful disturbance of a school.

Here’s where they say was running “near” the intersection of Bulldog Boulevard and South Raleigh. Bulldog runs through the school campus;

Sounds to me like the prosecutor still owes him two days since Alemar spent nine days in jail and got sentenced to seven days of ‘time served’.

[Games-Neely] said the police response to the incident and the charges that were originally filed were appropriate given the circumstances. At the time of his arrest, authorities didn’t know Alemar was a member of the military. Further investigation confirmed Alemar to be a member of the Virginia National Guard’s Company B, 3rd Battalion, 116th Infantry Brigade Combat Team, and that he was previously deployed to Iraq in 2011.

“They were absolutely right in taking him down the way they did. I’m grateful … that they were there very quickly and they did exactly what they were supposed to do. Mr. Alemar was within a gnat’s eyelash of them shooting him. It was that close, because it was that frightening to them and they are military people in addition to being officers,” Games-Neely said.

She also said that the she was appreciative that the victims in the case immediately contacted authorities after they saw Alemar.

Horseshit. As soon as the police determined that it wasn’t a real weapon, they should have backed-the-f**k-up. And what “victims”, FFS? Martinsburg should get prosecutor Games-Neely and officers Pyle and Fife some training in how to act like humans. Dipshit hicks. I’m sure Alemar pleaded guilty because he knew these halfwits were going to try to save face and that was the best he was going to get out of them.

  1. This particular case so incenses me, I would very much like to do things I cannot say. What the esteemed prosecutor had according to the now official court records is an inebriated soldier, something that anyone can find anytime. That’s the state’s case–public intoxication. And for that–OFFICIALLY–he spent days in jail, was locked up under $50, 000 cash-only bond, and suffered great embarrassment–not to mention what this episode did to his family. By the way, a few weeks ago in the same jurisdiction and under the same remarkably stupid prosecutor, a POS charged with multiple counts of child sexual abuse was held on 0nly $30,000 cash-only bond. The soldier screwed up but what he did pales in view of what the prsoecutor did in this case. Argggghhh.

  2. Fully agree, 2-17th AirCav. Hopefully the voters in her district will remember this bit of idiocy when she runs next (her office reputedly is elective vice appointive) – and suggest she find other employment.

    From what I’ve heard of the area, however, I’m not going to hold my breath.

  3. Common sense is severely lacking in many government positions these days. A “gnat’s eyelash of shooting him” had they done so I wonder how they would have explained the nice bright orange tip on the airsoft toy gun? Are the police in Martinsburg so inept they miss brightly colored objects and can’t connect the dots.

  4. Common sense went out the window after 9-11. We have a bunch of ‘there are Commies under every bed’ Chicken Littles. But give some limp dick some authority and watch what happens. Keep him locked up until he sobered up, call his CO, ream him up one wall and down the other then fine him and let him go.

  5. ex AF, I don’t know if they would have to call his CO. Does the National Guard get blotter reports like AD?

  6. No, the CO would not have gotten a blotter report.

    FWIW, there are several local legislators who are asking pointed questions about this mess. They have gotten complaints and questions from interested parties from all corners of the map.

    But don’t let that stop others who might want to make some inquiries.

  7. In the age of active shooters, common sense says you don’t get drunk off your ass, gear up, and go running around in public looking like a school shooting waiting to happen.

    I agree he was over charged, but what did this moron expect was going to happen? Despite his “I was training,” line, I believe he was looking to provoke a reaction…and he got one, and it bit him in the ass.

    This was a dummy who played stupid games and won stupid prizes.

  8. Yeah Jack. I believe that there was a unanimous verdict on the charge of Felony Stupid for Alemar in prior coverages of this story here at TAH. Much booze oftentimes makes one much stupid. But the prosecutor–sober as the judge she would doubtless like to be–with time to evaluate the facts and determine appropriate charges, if any, elected to charge him with a terroristic act and treat him as Public Enemy #1. Even drunk and stupid doesn’t deserve that.
