Illegal alien charged with attempted murder after attacking federal agent

A couple of federal agents approached Gabriel Hurtado-Cariaco via initiating a traffic stop. They directed the illegal alien to get out of his vehicle with his arms up. However, when the detaining got underway, Hurtado-Cariaco chose to fight back. The illegal alien initially injured one of the agents, a female, and then later had her in a choke hold. The other agent ordered him to release the first agent, but Hurtado-Cariaco wouldn’t listen. The second agent placed the illegal in a choke hold, which caused Hurtado-Cariaco to release the first agent. The illegal alien attempted to escape on foot but was caught. Hurtado-Cariaco is being charged with attempted murder of a federal officer and one count of assault on a federal officer while inflicting bodily injury.

“Deadly violence against law enforcement officers will not be tolerated by this Department of Justice,” Attorney General Pam Bondi said in a statement. “We have charged this illegal alien with attempted murder.”

Special agents with Homeland Security Investigations and the FBI encountered Hurtado-Cariaco near his Sarpy County home when they attempted to carry out an active immigration-related warrant for his arrest, according to the DOJ.

The agents subsequently initiated a traffic stop, directing Hurtado-Cariaco to pull his vehicle over and exit with his arms raised. As the agents attempted to place Hurtado-Cariaco in handcuffs, he allegedly attacked one agent and proceeded to drag them to the ground.

Hurtado-Cariaco managed to throw the agent off of him, resulting in one agent striking her head and elbow on the pavement, prosecutors allege.

“[The agent] injured her head and elbow, but [she] rose up off the ground and began to try again to get Hurtado-Cariaco into federal custody,” the criminal complaint reveals.

A second agent continued to attempt to detain Hurtado-Cariaco, with both agents working together to place handcuffs on him, resulting in a “more violent reaction” as the three individuals fell to the ground in the scuffle.

While on the ground, Hurtado-Cariaco crawled behind the injured agent and proceeded to place her in a chokehold, while ignoring commands from the second agent, according to the DOJ.

“Hurtado-Cariaco appeared to choose to continue choking [the agent] rather than simply flee the scene,” the complaint states.

In an attempt to stop the attack, the second agent also placed Hurtado-Cariaco in a chokehold, forcing him to release the injured agent. Hurtado-Cariaco allegedly broke free from the chokehold and ran away on foot, with authorities locating him at his nearby apartment and taking him into custody.

  1. I don’t know if they are equipped with them but a taser at contact would have released the chokehold. Failing that, a 9mm to the skull definitely would have.

    1. A tazer to the nads would stop most any activity. If not the nads directly, the general area should suffice.

      1. As someone who stupidly volunteered to “ride the bull” for 5 unending seconds, it makes no difference where they put the damn thing. It hurts like a motherfucker!

        But unlike pepper spray, which is the gift that keeps on giving and giving and giving, once the taser shot is over, it’s over…thank God!

      2. Welp, one of them is an FBI agent. They are armed with a .4 caliber, .40 caliber Glock.

        1. I might add that the fan belt inspectors abandoned their 10 mm pistols for the .40 S&W caliber pistols cuz the girl agents couldn’t the recoil of the 10 mm’s. A fiend of a friend who was a senior agent kept his 10mm, he also had a 10mm submachine gun.

          1. I remember the FBI stopped using .45 ACP’s because the girls couldn’t because of recoil. I remember a WW2 training film showing women agents training with the Colt 1911 prepairing to go overseas and work with the underground forces, and it looked like they handled those guns very well. Now I think that it was the switchover from wheel guns after the FBI agents didn’t survive the Florida gunfight years ago. Hmm rgr769, now I think it was the 10MM’s. My memory ain’t like it used to be. Later Alligator.

            1. That’s funny stuff. I was originally trained on the 1911 by a 5’4″, 120lb female armorer that could shoot a flea off a tick’s dick.

            2. BIG difference between a 10mm and a .45ACP. The reduced 10mm load was adopted before they even had 10mm guns issued, not due to issues in training – they just wanted something a little less ‘enthusiastic.’ Doing so they found function issues with the guns designed for fullpower loads, so S&W designed the .40 SW as an equivalent load to the reduced 10, chambered in different guns. Kinda funny: the 10mm was almost obsolete and .40s were ubiquitous – now .40s are almost obsolete and there are multitudes of 10s out there.

            3. At some point after that shootout, they switched to 10 mm semi autos. Then the wymen couldn’t qualify cuz of the recoil, so the went to .40.

            4. The 1986 Miami Shootout saw some agents equipped with 9mms (S&W 459s), but most used .38s (or .357s loaded with .38 SPL +P).

              I’ve been lazy, and my work pistol is still loaded with Winchester Silvertips, but I’ve been wanting to buy some of this: Federal Law Enforcement 9mm Luger Ammunition 115 Grain +P+ Jacketed Hollow Point – 9BPLE. It’s a bit hotter than most 9mm (the G17 should be able to handle it), and I used to always carry the standard 9BP rounds 25+ years ago. I know hollow point technology has improved since then, but the Hi-Shok was always extremely accurate and reliable for me (back then I only had the 92F and Kel-Tec P11).

              I’m sorely tempted to get this by the time I have to requalify: FN 545® Tactical | FN® Firearms. It’ll set me back at least $1500 with a new holster, spare mags, and ammo, but I like the thought of 19 rounds of .45 ACP +P ready to go. One thing that’s holding me back right now is the lack of third-party accessories. I need to find a good Level II duty holster, and Safariland doesn’t seem to make one for the 545 (I think the 510 fits the same holsters, but like most security companies, we’re restricted to .38 SPL, 9mm, .40 S&W, and .45 ACP).

While most of me says the agent should’ve unholstered the duty weapon and put 2-3 rounds center mass in this clown, the realist in me says they have probably screwed up by going for attempted murder and the guy will walk when an aggravated assault followed by a jail term and then a one-way flight somewhere down south would have been better.

    In a circular sort of logic, I’m back to thinking the agent should’ve hammered this idiot with lethal force so as to prevent him walking—at all. Ever again.

    1. He is charged with the lesser included offense of assault on a federal officer, so he will end up in the federal pen serving 75% of his sentence, then ICE will ship him out to some other place south of of the border. He won’t be walking anywhere other than a cell.

  3. I don’t know the nebraska judges poilicies but if they are demoRats, the LEO could face a charge of excesive use force and the judge could make him appolige to the well meaning perp or spend time in the slammer… Who knows, only the Shadow knows
