Even defense lawyers don\u2019t attend grand jury proceedings, only prosecutors.<\/p>\n<p>Some evidence had come out at a bail hearing before a judge. After the bail hearing, McConville was allowed to be released without posting any money, meaning the judge didn\u2019t think proof of guilt was evident.<\/p>\n<p>McConville\u2019s lawyer had argued that this was a crystal-clear case of self-defense: Contrary to initial reports that McConville had approached Bryant, Bryant had actually crossed the street and confronted McConville, Craig V. A woman called 911 and told dispatchers she had shot a burglar. When deputies arrived, they found Josh Montgomery lying dead in the driveway.<\/p>\n<p>Undersheriff Jason Chennault confirmed that Montgomery was dead from two gunshot wounds. <\/p>\n<p>Ginger Snow told deputies a man had started banging on the doors and windows at her residence. She didn\u2019t know who the man was and told him to leave. She said he \u201cbacked off\u201d into a yard but then returned to her house, this time even more aggressive.<\/p>\n<p>Snow said she armed herself with a gun and opened the door. She said when the man threatened to kill her, she fired shots into the air to scare him.
