A rodeo was about to get underway on August 3, 2019, at Superior, Montana. The event started with the playing of the national anthem. But things didn’t go smoothly. A 13-year-old boy was on the ground, bleeding from the ear area and sporting a fractured skull. He had to be airlifted to Spokane, Washington, where he received treatment at a children’s hospital.<\/p>\n

Curt James Brockway claimed that he asked the boy to remove his hat out of respect for the national anthem. The boy cursed at him. This resulted in Curt Brockway’s grabbing the kid by the throat, lifting him up, and then throwing him down to the ground.<\/p>\n

A police report filed in the aftermath of the incident listed this account. Interviews with other witnesses substantiated most of this account. However, one woman stated that she did not hear Brockway ask for the hat to be removed.<\/p>\n

The boy’s mother said that the man just came up behind her son and attacked him. There was no verbal exchange before that. He simply targeted her son. She wasn’t at the scene when this happened, so this is presumably her son’s account.<\/p>\n

According to the affidavit, witnesses confirmed most of Brockway’s description of events, but one woman said she did not hear him ask the boy to take off his hat.<\/p>\n

The child had blood coming from his ears, a concussion and a fractured skull, the affidavit said.<\/p>\n

He was airlifted to Sacred Heart Children’s Hospital in Spokane, Washington, according to the document.<\/p>\n

The child’s mother, Megan Keeler, told CNN affiliate KPAX that she received a phone call shortly after dropping off her son at the fairgrounds to tell her that he was being taken to a local hospital.<\/p>\n

“Dude come up and grabbed him by his neck, picked him up and threw him to the ground head first,” Keeler told KPAX.<\/p>\n

“There was no exchange — nothing! He targeted (her son) and took him down,” she added.<\/p><\/blockquote>\n

Brockway’s lawyer is trying to pull some cards in defense of his client. One, the claim that his client believes that President Trump “told him to” or “implied” for him to do this. If you listen to the speech that President Trump makes regarding things like this, he does not call for violence. Just repercussions based on what legally could be done.<\/p>\n

The other card is the “disabled veteran with no life” card. His lawyer suggests that this is going to result in his client’s listening to someone that he identifies with. Thus, the “blame Trump’s rhetoric” card.<\/p>\n

His lawyer points out that Brockway received a traumatic brain injury as a result of a car accident that he was involved with. He used this to suggest that a TBI related symptom makes him susceptible to impulse-driven actions.<\/p>\n

Brockway has a previous arrest, charge, and conviction in his past. This involved using a gun against three people. He can no longer own one. He apparently was on probation for that event. The judge reinstated the supervisory element of that probation.<\/p>\n
