(FOX Carolina) \u2014 The district attorney won&#8217;t bring charges in a fatal Hendersonville shooting, they reported on Friday.<\/p>\n<p>    &#8220;When you go to someone else&#8217;s property, the law does support them defending themselves when they believe they&#8217;re going to die or be badly injured,&#8221;said DA Greg Newman in a morning press conference on the shooting.<\/p>\n<p>    &#8220;We will not be submitting an indictment. There are not facts to support a charge that we can successfully prosecute.&#8221;<\/p>\n<p>It&#8217;s been more than two weeks since the shooting death of James Stepp III on Brooklyn Avenue in Hendersonville County.<\/p>\n<p>In a Friday morning press conference, District Attorney Greg Newman said there will not be any charges, citing that the facts support self-defense in Stepp&#8217;s death.<\/p>\n<p>Stepp&#8217;s family rejects the decision, and a group gathered, calling for justice for James Stepp.<\/p>\n<p>The shooting took place July 3 at a Hendersonville business.<\/p>\n<p>Investigators say an argument broke out between the business owner and Stepp&#8217;s son, which led to the son being fired.<\/p>\n<p>The DA said the son called Stepp, who showed up and got into a fight with the owner, punching him a number of times.<\/p>\n<p>During the course of the fight the business owner took out a gun and fired three times before the gun jammed, fatally wounding Stepp.<\/p>\n<p>&#8220;The law supports what this man did,&#8221; Newman said of the shooter in the press conference. He called the case difficult, tragic and &#8220;not the way we want people to resolve their disputes.&#8221;<\/p><\/blockquote>\n<p>1 \/ 0 \/ 0<br \/>\nRead the entire article here: <a href=\"https:\/\/www.foxcarolina.com\/investigations\/da-cites-self-defense-no-charges-brought-in-fatal-hendersonville\/article_bebcdbbe-aa40-11e9-aafd-f3602067f3b4.html\">Fox Carolina<\/a><\/p>\n<p>Here&#8217;s a more detailed account of the incident:<\/p>\n<blockquote><p>Stepp\u2019s son, Jimmy, worked for Spinella at Spinella Trucking and Excavating Inc. and was fired the day of the incident after Spinella claimed Jimmy had damaged equipment, Newman said during a news conference Friday morning at the Henderson County Courthouse.<\/p>\n<p>The son was asked to leave the property, then returned and had a heated verbal exchange with Spinella, which led to his firing, according to Newman.<\/p>\n<p>Stepp then went to the business and confronted Spinella, Newman said. Stepp asked Spinella to give him his son\u2019s paycheck immediately, Newman said. Newman said Stepp was not invited onto the property and Spinella did not know who Stepp was.<\/p>\n<p>The incident quickly escalated, and Stepp punched Spinella in the head \u201cvery forcefully,\u201d which caused Spinella to fall to the ground facedown, according to Newman, adding that Stepp continued to punch Spinella in the head.<\/p>\n<p>A witness tried to break it up before getting tangled up and falling down, which allowed Spinella to turn enough to grab the pistol near the small of his back that he legally carried, Newman said.<\/p>\n<p>After grabbing his pistol, Spinella stuck the firearm into Stepp\u2019s chest and fired \u201cas many times as he could fire it,\u201d Newman said.<\/p><\/blockquote>\n<p><a href=\"https:\/\/www.goupstate.com\/news\/20190719\/da-brooklyn-avenue-shooting-was-self-defense-no-charges-to-be-filed\">Go Upstate.com<\/a><\/p>\n<p><strong>Seattle woman shoots burglary suspect who ignored warnings<\/strong><\/p>\n<blockquote><p>SEATTLE, Wash.
