Special Warfare Operator Chief Eddie Gallagher is standing accused of murder, aggravated assault, obstruction of justice and professional misconduct.
\nThe military judge, CAPT Aaron Rugh, has ordered the lead prosecutor removed from the case after defense lawyers accused the lead prosecution of spying on their emails.<\/p>\n
His defense attorneys are also considering filing a civil rights lawsuit against the Naval Criminal Investigative Service (NCIS), for misconduct. This on the heels of three witnesses for the prosecution now refusing to take the stand to testify.<\/p>\n
The judge has said it was not in his power to determine whether the lead prosecutor, CDR Christopher Czaplak, violated ethical or professional rules, but the potential for a probe into those actions required that he be removed from the prosecution.<\/p>\n
By The Associated Press <\/strong><\/p>\n SAN DIEGO \u2014 A new date has been set for the trial of a Navy SEAL accused of murder and attempted murder in the death of an Islamic State prisoner under his care and the shootings of two Iraqi civilians in Iraq in 2017.<\/p>\n Defense attorney Tim Parlatore said Thursday that the military judge granted his request to push the date back from June 10 to June 17.
