{"id":75688,"date":"2017-10-31T09:27:12","date_gmt":"2017-10-31T13:27:12","guid":{"rendered":"http:\/\/valorguardians.com\/blog\/?p=75688"},"modified":"2017-10-31T09:51:17","modified_gmt":"2017-10-31T13:51:17","slug":"judge-blocks-military-transgender-ban","status":"publish","type":"post","link":"https:\/\/www.azuse.cloud\/?p=75688","title":{"rendered":"Judge blocks military transgender ban"},"content":{"rendered":"<p>Chief Tango sends us a link to <a href=\"http:\/\/thehill.com\/policy\/defense\/357827-court-partially-blocks-trumps-directive-on-transgender-military-ban\">The Hill<\/a> which reports that Judge Colleen Kollar-Kotelly of the U.S. District Court for the District of Columbia  ruled against the administration policy which blocked the Department of Defense from recruiting transgender people for military service;<\/p>\n<blockquote><p>\u201cThe court finds that a number of factors\u2014including the sheer breadth of the exclusion ordered by the directives, the unusual circumstances surrounding the President\u2019s announcement of them, the fact that the reasons given for them do not appear to be supported by any facts, and the recent rejection of those reasons by the military itself \u2014 strongly suggest that Plaintiffs\u2019 Fifth Amendment claim is meritorious,\u201d she wrote.<\/p><\/blockquote>\n<p>I&#8217;m not sure how the Fifth Amendment applies. It states;<\/p>\n<blockquote><p>No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.<\/p><\/blockquote>\n<p>As it is with most liberal defense of their behavior, I think they&#8217;re just making shit up again.<\/p>\n<blockquote><p>\u201cThis is a complete victory for our plaintiffs and all transgender service members, who are now once again able to serve on equal terms and without the threat of being discharged,\u201d Shannon Minter, NCLR\u2019s legal director, said in a statement.<\/p>\n<p>\u201cThis court saw straight through the smokescreen the government tried to create to hide the bias and prejudice behind Trump\u2019s change in military policy,&#8221; added Jennifer Levi, director of GLAD\u2019s transgender rights project. &#8220;This clear, powerful ruling confirms that there is no legitimate reason to exclude transgender people from military service.\u201d<\/p><\/blockquote>\n<p>The &#8220;change in military policy&#8221; just altered the policy to return to the same way it existed last year &#8211; for 240 years. It&#8217;s not like transgender people were legally able to serve openly for centuries until this president came along.<\/p>\n<p>The judge did, however, deny the plaintiffs&#8217; motion to force the government to pay for reassignment surgery &#8211; the real reason that they want to shove this whole charade down the throats of the American taxpayers.<\/p>\n<blockquote><p>Despite the judge&#8217;s denial of the injunction on the ban for surgical funding, Minter and Levi told reporters on a conference call that transgender service members will be able to receive all medically necessary care.
