If you ever wanted another good reason to thank God you\u2019re NOT an expresso-sipping, cheese-eating Metrosexual Euroweenie – here it is.<\/p>\n

Recently, a German comedian wrote a satirical and suggestive poem about a public figure.\u00a0 He recited the poem on a German TV show.<\/p>\n

Unfortunately, in Europe their concept of freedom of speech (and of freedom in general) isn\u2019t quite the same as ours.\u00a0 The public figure was insulted \u2013 and requested a criminal investigation<\/em> of the comedian be opened.<\/p>\n

Why?\u00a0 It seems here that the public figure here was Turkey\u2019s Recep Tayyip Erdogan \u2013 a foreign head-of-state.\u00a0 And under an obscure provision of German law, that is not legal in Germany.\u00a0 Specifically, insulting a foreign head-of-state violates Article 103 of Germany\u2019s penal code.\u00a0 And that “crime” carries a maximum penalty of 3 years in prison<\/em> – or up to 5 years<\/em> if it is deemed a “slanderous insult”.<\/p>\n

No, I\u2019m not joking<\/a>. <\/em><\/p>\n

On Ergodan\u2019s request, German Chancellor Angela Merkel has approved initiation of a criminal investigation into the matter.\u00a0\u00a0 She\u2019s also indicated she will \u201cmove to repeal the controversial and little-used Article 103 of the penal code\u201d by 2018.<\/p>\n

Yeah, I’m sure the German comedian in question is just thrilled to hear about the latter.<\/p>\n

Logically, this should go over well in Berkeley and similar places.\u00a0 After all, criminalizing free speech helps to create “safe spaces” where people are protected from “disturbing speech and ideas”.\u00a0 But in the rest of the US . . . maybe not so much.<\/p>\n
