{"id":64303,"date":"2016-02-12T12:25:48","date_gmt":"2016-02-12T17:25:48","guid":{"rendered":"http:\/\/valorguardians.com\/blog\/?p=64303"},"modified":"2016-02-12T11:26:28","modified_gmt":"2016-02-12T16:26:28","slug":"bergdahl-court-martial-on-hold","status":"publish","type":"post","link":"https:\/\/www.azuse.cloud\/?p=64303","title":{"rendered":"Bergdahl Court-Martial On Hold"},"content":{"rendered":"<p>It appears that Bergdahl\u2019s court-martial <em><a href=\"http:\/\/www.stripes.com\/news\/us\/bergdahl-court-martial-halted-as-dispute-over-classified-info-continues-1.393241\">is now on hold.<\/a><\/em><\/p>\n<p>Bergdahl is facing court-martial for desertion and misbehavior before the enemy.\u00a0 His defense team has asserted that they need access to certain classified materials to defend Bergdhal.\u00a0 The prosecution disputes this.<\/p>\n<p>The trial judge granted Bergdahl&#8217;s defense be given access.\u00a0 However, the prosecution has appealed this decision to a higher military court.\u00a0 We&#8217;re now awaiting that appeals court decision \u2013 and everything else is on hold until that decision is announced.<\/p>\n<p>As <u>Political Insider<\/u> <em><a href=\"http:\/\/www.thepoliticalinsider.com\/military-lawyers-stopped-bergdahl-treason-case-will-shock\/\">notes here<\/a><\/em>, the defense&#8217;s assertion is bull regarding the charge of desertion. Proving the specific form of desertion with which Bergdahl is charged merely requires proving that he absented himself to avoid hazardous duty. Leaving post without authorization in a combat zone to go AWOL constitutes exactly that, and proving that is simple \u2013 he either did or he did not absent himself. Nothing classified about that, and nothing classified needed to defend the case.<\/p>\n<p>Bergdahl\u2019s legal team may or may not need access to classified materials in order to defend him against the charges of misbehavior before the enemy. Depending on precisely what evidence or theory the prosecution plans to present to prove that charge, the defense could indeed need access to classified information to defend.<\/p>\n<p>However, I think it\u2019s far more likely that this is a classic instance of <em><a href=\"https:\/\/en.wikipedia.org\/wiki\/Graymail\">graymail<\/a><\/em>. My guess is that the defense team is merely trying to prevent the public from finding out just how badly Bergdahl behaved while enjoying Thursdays with the Taliban and\/or the Haqqani Network. Doing so might be necessary to preserve future book deals and such. So they\u2019re requesting info to material that\u2019s highly classified and hoping that the government flatly refuses to comply and the judge pitches the case.<\/p>\n<p>Stay tuned.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It appears that Bergdahl\u2019s court-martial is now on hold.
