Yesterday, the Washington Post<\/span> published \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0some anti-gun propaganda<\/span>\u00a0\u00a0\u00a0\u00a0 an article.\u00a0 Its title tells you all you really need to know about it:<\/p>\n

The \u201clegal loophole\u201d that allowed Dylann Roof to get a gun<\/a><\/em><\/strong><\/p>\n

I\u2019ve put \u201clegal loophole\u201d there in quotes for a couple of reasons.\u00a0 The first reason is \u2013 it\u2019s absolute bullsh!t, and it\u2019s misleading as hell. IMO, that\u2019s by intent.<\/p>\n

The second reason is that it the whole article appears to be factually incorrect.\u00a0 No \u201clegal loophole\u201d – imaginary or otherwise – appears to have been involved at all.<\/p>\n

Here are the facts of the case.<\/p>\n

The apparently-racist bastard named Dylann Roof who murdered 9 innocents in Charleston was arrested for felony drug possession 28 February of this year<\/a>.\u00a0 According to the WaPo \u00a0 \u00a0 \u00a0\u00a0 propaganda<\/del> \u00a0 \u00a0 \u00a0 article, he obtained the weapon used in his crime as a birthday present this April<\/a>.\u00a0 (This now appears to have been proven false \u2013 I\u2019ll cover that below).<\/p>\n

The WaPo writer seizes on this, claiming that this is the result of the \u201cgun show loophole\u201d. \u00a0 He does so after acknowledging that it was already illegal under current Federal law for him to have been given a weapon as a gift while under indictment for a felony crime \u2013 see 18 USC 922(d)(1).<\/a><\/p>\n

So, even if the original reports of Roof receiving the firearm he used in his murders as a gift had been true, the reporter’s article would still have been bullsh!t.\u00a0 Why?\u00a0 Because there was no freaking “legal loophole” here.\u00a0 Roof was facing felony charges – and his family had to know he’d been arrested.\u00a0 They thus had good reason to suspect he could be facing felony charges – and therefore giving him a weapon would have already been illegal under Federal law<\/span>.\u00a0 There’s no “loophole” there, folks.<\/p>\n

In fact, later news reports indicate that Roof in fact bought the gun himself at a local gun shop<\/a>.\u00a0 My guess is that he probably falsified the purchase form (ATF Form 4473) and claimed he was not under “indictment or information” for any felony crime.\u00a0 (I’m pretty sure that being out on bail after arrest while awaiting further court action virtually guarantees the latter – e.g., that Roof was legally considered “under information” of a felony, even if he hadn’t been formally indicted by a grand jury.)\u00a0 Falsifying an ATF 4473 is also a Federal felony.\u00a0 I suppose it\u2019s theoretically possible that the gun shop was \u201cdirty\u201d and ignored a truthful answer \u2013 but since that\u2019s kinda easily discovered, I rather doubt it.\u00a0 Most business owners want to stay in business and stay out of jail.<\/p>\n

I\u2019ll spell it out for any logic-challenged \u201cliberal brethren\u201d who might be reading this. Roof was apparently willing to lie on the purchase form in order to purchase a firearm himself.\u00a0 That is itself a felony.\u00a0 So, how would requiring him to take a firearm received as a gift down to the same firearms shop to \u201ccomplete the transfer\u201d for a gift have made any difference?<\/p>\n

Answer: it wouldn\u2019t have<\/span>.\u00a0 He’d have simply lied on the ATF 4473 then, too.<\/p>\n

However . . . having him do that to “complete the transfer” would indeed assist in later compiling a database of who owns firearms, should anyone in the future want to do so.<\/p>\n

Bottom line:\u00a0 that WaPo \u00a0 \u00a0 \u00a0\u00a0 propaganda<\/span>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 article yesterday wasn\u2019t about gun safety at all.\u00a0 It was about misleading people.\u00a0 It was designed to convince people to support whatever is necessary to facilitate backdoor gun registration in the future \u2013 plain and simple.<\/p>\n","protected":false},"excerpt":{"rendered":"
