{"id":57466,"date":"2015-01-04T08:00:12","date_gmt":"2015-01-04T13:00:12","guid":{"rendered":"http:\/\/valorguardians.com\/blog\/?p=57466"},"modified":"2015-01-03T18:57:30","modified_gmt":"2015-01-03T23:57:30","slug":"navy-vetretired-cop-sues-ny-state","status":"publish","type":"post","link":"https:\/\/www.azuse.cloud\/?p=57466","title":{"rendered":"Navy vet\/retired cop sues NY State"},"content":{"rendered":"<p>Donald Montgomery, a Navy veteran and a retired police detective has filed a lawsuit against the State of New York claiming that the new SAFE Act went too far when New York State used it to confiscate his firearms, according to the <a href=\"http:\/\/dailycaller.com\/2015\/01\/02\/veteran-and-former-cop-sues-after-guns-confiscated-because-he-sought-treatment-for-insomnia\/\">Daily  Caller<\/a>;<\/p>\n<blockquote><p>Montgomery\u2019s woes began on May 6 when he sought treatment from his primary care physician for insomnia, which he said he had been experiencing following a move from another state.<\/p>\n<p>[&#8230;]<\/p>\n<p>Staff there diagnosed Montgomery with \u201cDepression; Insomnia\u201d and he was prescribed medication and told to report back to his primary care physician if symptoms worsened over the next several days.<\/p>\n<p>Montgomery went back to the hospital on May 23 with the same complaint. He stayed at the facility for 48 hours.<\/p>\n<p>Though Montgomery voluntarily sought treatment, he alleges in the suit that staff at the facility erroneously listed him as an involuntary admission \u2014 a designation that appears to have put the SAFE Act\u2019s wheels in motion.<\/p><\/blockquote>\n<p>A clerical error, a checked box, cost Montgomery his constitutional rights.<\/p>\n<blockquote><p>\u201cNurse\u2019s notes\u201d from Montgomery\u2019s stay show no documentation of mental health issues.<\/p>\n<p>\u201cPatient has no thoughts of hurting himself. Patient has no thoughts of hurting others. Patient is not having suicidal thoughts. Patient is not having homicidal thoughts,\u201d the notes read.<\/p>\n<p>A psychological assessment labeled him \u201cmildly depressed,\u201d but otherwise determined \u201cthere is no evidence of any psychotic processes, mania, or OCD symptoms.\u201d<\/p><\/blockquote>\n<p>The SAFE Act is so tightly wired that a little insomnia triggered the loss of Constitutional rights for a vet\/cop.
