{"id":36629,"date":"2013-07-14T09:54:47","date_gmt":"2013-07-14T13:54:47","guid":{"rendered":"http:\/\/valorguardians.com\/blog\/?p=36629"},"modified":"2013-07-14T09:54:47","modified_gmt":"2013-07-14T13:54:47","slug":"presidents-remarks-complicate-military-prosecutions","status":"publish","type":"post","link":"https:\/\/www.azuse.cloud\/?p=36629","title":{"rendered":"President&#8217;s remarks complicate military prosecutions"},"content":{"rendered":"<p><a href=\"http:\/\/www.nytimes.com\/2013\/07\/14\/us\/obama-remark-is-complicating-military-trials.html?pagewanted=all\">The New York Times<\/a> makes the case that President Obama&#8217;s recent remarks regarding military sexual assault cases will alter the outcome of those trials by causing  \u201cunlawful command influence\u201d;<\/p>\n<blockquote><p> \u201cUnlawful command influence\u201d refers to actions of commanders that could be interpreted by jurors as an attempt to influence a court-martial, in effect ordering a specific outcome. Mr. Obama, as commander in chief of the armed forces, is considered the most powerful person to wield such influence.<\/p>\n<p>The president\u2019s remarks might have seemed innocuous to civilians, but military law experts say defense lawyers will seize on the president\u2019s call for an automatic dishonorable discharge, the most severe discharge available in a court-martial, arguing that his words will affect their cases.<\/p>\n<p>\u201cHis remarks were more specific than I\u2019ve ever heard a commander in chief get,\u201d said Thomas J. Romig, a former judge advocate general of the Army and the dean of the Washburn University School of Law in Topeka, Kan. \u201cWhen the commander in chief says they will be dishonorably discharged, that\u2019s a pretty specific message. Every military defense counsel will make a motion about this.\u201d <\/p><\/blockquote>\n<p>And of course, civilians won&#8217;t understand the military culture and therefore, demonize the whole process when someone gets to walk free because this President doesn&#8217;t understand the military culture.
