{"id":34908,"date":"2013-04-03T08:18:33","date_gmt":"2013-04-03T12:18:33","guid":{"rendered":"http:\/\/valorguardians.com\/blog\/?p=34908"},"modified":"2013-04-03T08:18:33","modified_gmt":"2013-04-03T12:18:33","slug":"the-purple-heart-for-fort-hood-victims","status":"publish","type":"post","link":"https:\/\/www.azuse.cloud\/?p=34908","title":{"rendered":"The Purple Heart for Fort Hood victims"},"content":{"rendered":"<p>Derek and MCPO Ret. in TN send us a link to <a href=\"http:\/\/www.cnn.com\/2013\/04\/02\/us\/pentagon-purple-hearts\/index.html?hpt=hp_t5\">CNN<\/a> which discusses the reasons that the Department of Defense won&#8217;t award a Purple Heart to Nidal Hasan&#8217;s victims, and it has to do with lawyer shit;<\/p>\n<blockquote><p>The Defense Department argues that awarding the Purple Heart to the Fort Hood victims would make it harder to convict Hasan in the death-penalty case and &#8220;deprive the victims of these crimes the right to see justice done.&#8221;<\/p>\n<p>&#8220;Defense counsel will argue that Major Hasan cannot receive a fair trial because a branch of government has indirectly declared that Major Hasan is a terrorist &#8212; that he is criminally culpable,&#8221; the document states. That could lead to a delay of the case or the reversal of a guilty verdict on appeal, it continued.<\/p>\n<p>&#8220;This laudable sentiment mistakenly and unwillingly supplants the criminal trial process by infusing official, formal statutory conclusions about the motive, intent and culpability of the man charged with the crime,&#8221; the memo reads.<\/p><\/blockquote>\n<p><object width=\"416\" height=\"234\" classid=\"clsid:D27CDB6E-AE6D-11cf-96B8-444553540000\" id=\"ep_211\"><param name=\"allowfullscreen\" value=\"true\" \/><param name=\"allowscriptaccess\" value=\"always\" \/><param name=\"wmode\" value=\"transparent\" \/><param name=\"movie\" value=\"http:\/\/i.cdn.turner.com\/cnn\/.element\/apps\/cvp\/3.0\/swf\/cnn_embed_2x_container.swf?site=cnn&#038;profile=desktop&#038;context=embedwww&#038;videoId=us\/2013\/04\/02\/tsr-lawrence-fort-hood-medals.cnn&#038;contentId=us\/2013\/04\/02\/tsr-lawrence-fort-hood-medals.cnn\" \/><param name=\"bgcolor\" value=\"#000000\" \/><embed src=\"http:\/\/i.cdn.turner.com\/cnn\/.element\/apps\/cvp\/3.0\/swf\/cnn_embed_2x_container.swf?site=cnn&#038;profile=desktop&#038;context=embedwww&#038;videoId=us\/2013\/04\/02\/tsr-lawrence-fort-hood-medals.cnn&#038;contentId=us\/2013\/04\/02\/tsr-lawrence-fort-hood-medals.cnn\" type=\"application\/x-shockwave-flash\" bgcolor=\"#000000\" allowfullscreen=\"true\" allowscriptaccess=\"always\" width=\"416\" wmode=\"transparent\" height=\"234\"><\/embed><\/object><\/p>\n<p>It would make it &#8220;harder to convict Hasan&#8221;? How is that?  The article continues that the prosecutors will tell the jury that Hasan yelled &#8220;Allah Akbar&#8221; while he shot unarmed people. Before the shootings, he was in communication with Anwar al-Awlaki, someone that the US government determined was a terrorist threat to the US and sent him a catered Hellfire lunch. I don&#8217;t see how it could be hard to convict Hasan of being a terrorist, since what he did is terrorism. From U.S. Code Title 22, Ch.38, Para. 2656f(d); <em>the term \u201cterrorism\u201d means premeditated, politically motivated violence perpetrated against noncombatant targets by subnational groups or clandestine agents<\/em>.<\/p>\n<p>I&#8217;m no lawyer, but some of you are.
