Two of his guns were discovered at the scene of border agent Brian Terry&#8217;s murder.<\/p>\n<blockquote><p>Avila\u2019s attorney, Candice Shoemaker, said her client\u2019s \u201csignificant substance abuse problem\u201d led to his involvement in the smuggling operation and added that Avila was \u201cshocked and dismayed and hurt in a way that he had no idea his behavior \u2026 would lead to such great lengths.\u201d She said he was recruited to participate in the smuggling scheme and added that he was \u201cnot a gentleman who grew up in gangs.\u201d<\/p>\n<p>Terry\u2019s cousin, Robert Heyer, who runs the Brian Terry Foundation, had asked the judge to impose the maximum 10-year sentence.<\/p><\/blockquote>\n<p>Five years for the murder of a border agent is a pretty good deal. Ten years would have been a good deal, too.
