You might remember we quoted his long list of things we say that equate in his tiny, closed mind to &#8220;I was a Marine and was awarded the Medal of Honor&#8221;;<\/p>\n<blockquote><p>We lie to protect our privacy (\u201cNo, I don\u2019t live around here\u201d); to avoid hurt feelings (\u201cFriday is my study night\u201d); to make others feel better (\u201cGee you\u2019ve gotten skinny\u201d);to avoid recriminations (\u201cI only lost $10 at poker\u201d); to prevent grief (\u201cThe doc says you\u2019re getting better\u201d); to maintain domestic tranquility (\u201cShe\u2019s just a friend\u201d); to avoid social stigma (\u201cI just haven\u2019t met the right woman\u201d); for career advancement (\u201cI\u2019m sooo lucky to have a smart boss like you\u201d); to avoid being lonely (\u201cI love opera\u201d); to eliminate a rival (\u201cHe has a boyfriend\u201d); to achieve an objective (\u201cButI love you so much\u201d); to defeat an objective (\u201cI\u2019m allergic to latex\u201d); to make an exit (\u201cIt\u2019s not you, it\u2019s me\u201d); to delay the inevitable (\u201cThe check is in the mail\u201d); to communicate displeasure (\u201cThere\u2019s nothing wrong\u201d); to get someone off your back (\u201cI\u2019ll call you about lunch\u201d); to escape a nudnik (\u201cMy mother\u2019s on the other line\u201d); to namedrop (\u201cWe go way back\u201d); to set up a surprise party (\u201cI need help moving the piano\u201d); to buy time (\u201cI\u2019m on my way\u201d); to keep up appearances (\u201cWe\u2019re not talking divorce\u201d); to avoid taking out the trash (\u201cMy back hurts\u201d); to duck an obligation (\u201cI\u2019ve got a headache\u201d); to maintain a public image (\u201cI go to church every Sunday\u201d); to make a point (\u201cIch bin ein Berliner\u201d); to save face (\u201cI had too much to drink\u201d); to humor (\u201cCorrect as usual, King Friday\u201d); to avoid embarrassment (\u201cThat wasn\u2019t me\u201d); to curry favor (\u201cI\u2019ve read all your books\u201d); to get a clerkship (\u201cYou\u2019re the greatest living jurist\u201d); to save a dollar (\u201cI gave at the office\u201d); or to maintain innocence (\u201cThere are eight tiny reindeer on the rooftop\u201d).<\/p><\/blockquote>\n<p>But, because I don&#8217;t read legal opinions, these are new to us;<\/p>\n<blockquote><p>And we don\u2019t just talk the talk, we walk the walk, as reflected by the popularity of plastic surgery, elevator shoes, wood veneer paneling, cubic zirconia, toupees, artificial turf and cross-dressing. Last year, Americans spent $40 billion on cosmetics\u2014an industry devoted almost entirely to helping people deceive each other about their appearance. It doesn\u2019t matter whether we think that such lies are despicable or cause more harm than good. An important aspect of personal autonomy is the right to shape one\u2019s public and private persona by choosing when to tell the truth about oneself, when to conceal and when to deceive. Of course, lies are often disbelieved or discovered, and that too is part of the pull and tug of social intercourse. But it\u2019s critical to leave such interactions in private hands, so that we can make choices about who we are. How can you develop a reputation as a straight shooter if lying is not an option?<\/p><\/blockquote>\n<p>Yes, wood paneling is exactly like claiming military honors which weren&#8217;t earned. Eye make up is like wearing a Purple Heart when the wearer wasn&#8217;t wounded in combat. Cubic zirconia is just like claiming to have served in combat when you&#8217;ve never left Fort Living Room.<\/p>\n<p>Lat thinks this is cute of Kozinski. I think they&#8217;re both shallow, disrespectful, ignorant turds. <\/p>\n<p>And as a long-serving Federal Appeals Court Chief Judge, I&#8217;ve determined that they&#8217;re both wrong on points of law, too.
