Been following this one a while – earlier this year at Stonebridge High School in the Loudon County Public School (LCPS) system,a couple of boys questioned why a transgirl was in their locker room (and being filmed by another trans student.)\u00a0 No abuse, just saying they were uncomfortable and why was he\/she\/it in there. Well, the other shoe dropped in August when both the boys received suspensions – not warnings, not detention, but permanent-record suspensions.<\/p>\n

The Loudoun County Public Schools (LCPS) is suspending the Stone Bridge High School students for 10 days following a Title IX investigation into the incident earlier this year, attorney Josh Heltzer, who represents the boys\u2019 families, told 7News.<\/p>\n

Heltzer said that LCPS found the boys to be responsible for sexual harassment and sex-based discrimination in a case that has sparked a furious response from parents the boys’ parents as well as Virginia\u2019s attorney general, who has argued that the school agency’s process was biased and retaliatory.<\/p>\n

Both Wolfe and Smith said that LCPS is sending a message that any student who expresses views that disagree with Policy 8040 will be punished. Policy 8040 is a controversial guideline adopted in 2021 that permits students to use restrooms and locker rooms that align with their gender identity rather than their biological sex.\u00a0\u00a0Fox News<\/a><\/p><\/blockquote>\n

Seems a bit heavy-handed and extreme, no? Do we see a lawsuit coming? Absolutely. Fast forward:<\/p>\n

A federal judge ordered parents involved in the controversial Loudoun County locker room dispute to post a $125,000 bond to continue the case.<\/p>\n

The students won emergency relief in federal court last month, blocking the district’s disciplinary repercussions once again while the case moves forward.<\/p>\n

According to a local report, the judge’s recent order “aims to ensure that if LCPS prevails on dispositive pre-trial motions, LCPS can recover from that bond its attorney\u2019s fees.”<\/p><\/blockquote>\n

And what about the parents’ finances? We looking at some judicial prejudice on Judge Leonie Brinkma’s part here? October 15, the 5-days-later date the judge demanded the funding (worth noting: he school district admitted in court that its insurance covers the legal bills.!)<\/p>\n

“They come here and find Title IX violations against boys for merely expressing discomfort with a girl in the boys’ locker room. We know exactly why they did that. It’s all politically motivated,” he said.<\/p>\n

According to reports, the district’s court filing suggested that the transgender student in subject had complained of “relentless” harassment leading up to the Title IX complaint.<\/p><\/blockquote>\n

Notice the lack of accusing the boys involved of any real harassment? It’s based on the trans kid being picked on by others? Telling statement:<\/p>\n

“The Virginia Attorney General’s office found that these boys’ Title IX rights were violated. The United States Department of Education found that these boys’ Title IX rights were violated,” he said. Fox News II<\/a><\/p><\/blockquote>\n

So the judge makes the parents put up $125,000… how many of you have a spare 1\/8 mill hanging around? Especially to be forked over in 5 days?<\/p>\n

Now we finally get to the good news part of the story. The parents, as anyone needing cash in a hurry now, set up on-line giving pages for help. Between fundraising (and an angel investor who threw in $50K) they got close enough to keep the injunction against he suspensions alive while this is being litigated.\u00a0 Fox News III<\/a><\/p>\n

Interesting case – the boys are accused of sexual harassment and discrimination over simple conversation (with each other.) Anyone notice that this was filmed in a locker room, which IS\u00a0 illegal? The LCPS decided that wasn’t illegal because none of the bboys was in a “compromising position” – betcha the text of the law doesn’t mention that. Any of you lawers know?<\/p>\n
