\u2018Career Criminal\u2019 Shot During Subway Robbery Attempt at Penn Station<\/strong><\/p>\n

A robbery attempt at Penn Station turned chaotic Tuesday evening when an off-duty NYPD officer shot a suspect during a violent scuffle on the subway platform.<\/p>\n

PIX11 News reports the suspect, identified as 32-year-old Jahmar Stewart, is a \u201ccareer criminal\u201d with five prior arrests, including one just last month for multiple assaults.<\/p>\n

The incident unfolded around the evening rush on Track 18. Police sources say that Stewart tried to rob two off-duty officers\u2014a couple heading home to Long Island after working UN security details.<\/p>\n

During the confrontation, the male officer was cut on his head as he fought Stewart on the platform.<\/p>\n

Believing Stewart may have had a weapon, the female officer drew her firearm and fired at least one shot, striking Stewart in the arm.<\/p>\n

No weapon was recovered at the scene, but sources said the officers acted quickly to stop the threat in the crowded station.<\/p>\n

Witnesses described the tense moment, with commuters caught off guard in the middle of the rush-hour crowd.<\/p>\n

\u201cThese officers put themselves on the line every day,\u201d one bystander told PIX11. \u201cThey had to make a split-second decision, and they\u2019ll be judged for it.\u201d<\/p>\n

Stewart was rushed to Bellevue Hospital, where he is expected to survive. He is being charged with attempted robbery and assault, per ABC 7 News.<\/p><\/blockquote>\n

Judge dismisses felony charges in Cedar City road rage shooting, citing self-defense<\/strong><\/p>\n

\nA 5th District Court judge has dismissed multiple felony charges against a Cedar City motorcyclist accused of shooting a man during a road rage confrontation, ruling the shooting was an act of self-defense.<\/p>\n

In a 14-page decision issued Monday, Judge Meb Anderson dismissed one count of felony discharge of a firearm with serious bodily injury and one count of aggravated assault against 47-year-old Jason Bryan Stolworthy.<\/p>\n

Those two most serious charges were dismissed with prejudice, meaning they cannot be refiled. Two counts of reckless endangerment were dismissed without prejudice, leaving the option for prosecutors to pursue them again.<\/p>\n

Stolworthy still faces charges of obstruction of justice and reckless driving. His bail was reduced from $200,000 to $10,000.<\/p>\n

The ruling stems from a June 12, 2024, altercation near Main Street and Fiddlers Canyon Road, where Stolworthy shot the driver of a white Mercedes. The driver, identified as Robert Mabbitt, survived and later recovered from his injuries.<\/p>\n

Anderson ruled that Mabbitt was the primary aggressor and found Stolworthy reasonably believed deadly force was necessary to stop another attack. He cited both gas station surveillance video and a bystander\u2019s cellphone recording as key evidence.<\/p>\n

The footage shows Mabbitt striking Stolworthy through his helmet visor, which knocked him off his motorcycle. After the fall, Mabbitt continued moving toward Stolworthy in an aggressive manner.<\/p>\n

\u201cThe Court finds that subjective and objective imminence existed, and Stolworthy reasonably believed force was necessary,\u201d Anderson wrote. He noted that Mabbitt closed distance on Stolworthy and shouted threats just before the shooting.<\/p>\n

Although Anderson called Stolworthy\u2019s decision to chase Mabbitt\u2019s car during the lead-up to the incident \u201cirresponsible and inadvisable,\u201d he ruled it did not prove intent to provoke a fight.<\/p>\n

\u201cOnce parked, it is clear from video evidence \u2026 that Stolworthy was not the aggressor. Stolworthy remains on his bike as Mabbitt approaches,\u201d the judge noted.<\/p><\/blockquote>\n
