Mr. Culotta was pulled over in Massachusetts June 24 and had (gasp) guns he legally owned in the car he was driving owned by his fiancee, Sarande Jackson.<\/p>\n<blockquote><p>Culotta was arrested June 24 in Gardner, a day after he entered the state, after police found three handguns, five rifles, and a \u201cfully stocked military-style ammo\u201d case in a vehicle he was driving during a traffic stop, authorities said. Culotta also had a pistol in his pocket while talking to police, according to court documents.<\/p>\n<p>The former Air Force postal specialist did not have a Massachusetts license to carry the firearms, but informed police officers that he had weapons in the car and the pistol in his pocket when he was pulled over driving Jackson\u2019s vehicle, court documents said.<\/p>\n<p>Two judges later found Culotta posed a threat to the local community and ordered him held without bail while his case plays out in court, decisions Jackson said are \u201cliterally political because of this law they passed.\u201d<\/p><\/blockquote>\n<p>Massachusetts bans magazines of over 10 round capacity, and any magazines that can be modified to hold more than 10 rounds.<\/p>\n<p>The man was moving to the Bay State when he was pulled over. None of the guns were loaded when he was pulled over except the gun he was carrying. OK, so far it seems he failed to get the available Mass temporary firearms ID &#8211; but he is being held without bail like a domestic terrorist.<\/p>\n<blockquote><p>A spokesperson for Worcester County District Attorney Joseph Early, whose office is prosecuting the case, declined to comment.<\/p>\n<p>Culotta unsuccessfully appealed the decision in Worcester County Superior Court.<\/p>\n<p>A Superior Court judge ruled that Culotta should be held behind bars because he had \u201cmultiple guns + rifles incl loaded + also incl lg cap,\u201d a reference to the multiple firearms found in the vehicle and a large capacity magazine in the pistol, according to court documents.<a href=\"https:\/\/www.military.com\/daily-news\/2025\/09\/18\/gun-advocates-petition-massachusetts-highest-court-free-veteran-facing-gun-possession-charges.html?ESRC=eb_250919.nl&amp;utm_medium=email&amp;utm_source=eb&amp;utm_campaign=20250919\">Military.com<\/a><\/p><\/blockquote>\n<p>If you travel with a gun, please please PLEASE make sure you know the gun laws in the states you will be in. Some, like Massachusetts, New Jersey, Maryland, etc. are demented.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-174076 aligncenter\" src=\"https:\/\/www.azuse.cloud\/wp-content\/uploads\/2025\/09\/OIP-2695899835-300x168.jpg\" alt=\"\" width=\"300\" height=\"168\" srcset=\"https:\/\/www.azuse.cloud\/wp-content\/uploads\/2025\/09\/OIP-2695899835-300x168.jpg 300w, https:\/\/www.azuse.cloud\/wp-content\/uploads\/2025\/09\/OIP-2695899835.jpg 474w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>And then there is an Army vet Vontae Garrett, and former special-deputy sheriff, arrested in Sylvania, OH for\u00a0 &#8220;felony mishandling a firearm in a vehicle&#8221;. Meaning he had a loaded gun within reach. The key, here, though, is that under Ohio law Garrett is innocent.<\/p>\n<blockquote><p>Court documents show a misunderstanding of Ohio law, arguing that Garrett&#8217;s Indiana concealed carry license is not valid in Ohio and that Indiana, Garrett&#8217;s home state, does not have reciprocity with Ohio. However, prosecutors are wrong on the law.<\/p>\n<p>Ohio has automatic reciprocity with every other state \u2014 a fact stated on the Ohio Attorney General&#8217;s website:<\/p>\n<blockquote><p>Effective March 23, 2015, Ohio recognizes the concealed handgun license of any non-resident who has a valid concealed handgun license from any other state, regardless of whether Ohio has entered into a reciprocity agreement with that state. \u00a0\u00a0<strong><a href=\"https:\/\/www.ohioattorneygeneral.gov\/Law-Enforcement\/Concealed-Carry\/Concealed-Carry-Reciprocity-Agreements\" target=\"_blank\" rel=\"noopener\">Ohio AG<\/a><\/strong><\/p><\/blockquote>\n<\/blockquote>\n<p>And Indiana has &#8220;constitutional carry&#8221;, so no permit or license is even required there. But there is also another thing:<\/p>\n<blockquote><p>But these arguments are not only improper; they are irrelevant because Ohio is a constitutional carry state allowing anyone who is not disqualified, resident or nonresident, to carry or transport a firearm.<\/p>\n<p>Despite these facts, the Lucas County Sherriff\u2019s Office and the Sylvania Prosecutor\u2019s Office have refused to drop the charges and are deliberately ignoring Ohio law.<\/p>\n<p>Worse, and perhaps most egregiously, according to court filings, the Sylvania Prosecutor\u2019s Office has taken the extraordinary position that anyone \u2014 even those holding a valid concealed handgun license \u2014 may be arrested and charged simply for having a loaded firearm in their car.\u00a0 \u00a0<a href=\"https:\/\/www.buckeyefirearms.org\/buckeye-firearms-association-blasts-sylvania-prosecutors-office-illegal-prosecution-gun-owner\">BFA<\/a><\/p><\/blockquote>\n<p>Sylvania is a county (near Toledo if you care)\u00a0 of about 20,000 population , at least a few of which seem to want to fabricate laws from whole cloth.<\/p>\n<p>These kinds of cases illustrate why Congress and the Supremes must act to\u00a01) Enact national reciprocity &#8211; if a gun owner is licensed in ANY state, the license should be good nationwide like a driver&#8217;s license.\u00a0 2) The Supreme Court needs to make it clear to states like New York, California, Massachusetts, and others that federal law overrides state law and that the states cannot enact more restrictive laws than US laws.<\/p>\n<p>I look forward to Mr. Garrett suing Sylvania County for lots and lots of money&#8230;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>We have the case of 51-year old Air Force vet Kyle Culotta up first.
