North Carolina man not charged in deadly shooting; \u2018acted to defend himself\u2019<\/strong><\/p>\n

\nASHEVILLE, N.C. (WSPA) \u2014 No charges have been filed in a shooting that left one person dead and others injured over the weekend in Asheville.<\/p>\n

According to the Asheville Police Department, at around 12:07 a.m. Sunday officers were called to Rankin Avenue near College Street for a reported shooting. At the scene, they found Andy Garcia Porras dead in the roadway and multiple others who were hit or grazed by gunfire.<\/p>\n

Is it legal to shoot someone in self-defense in North Carolina?
\nAfter investigating the shooting, police, in consultation with the Buncombe County District Attorney\u2019s Office, determined the shooting was in self-defense.<\/p>\n

According to police, the incident began when the bouncer of a nightclub saw two men, including Porras, harassing a group of women and then denied those men entry into the club.<\/p>\n

Police said Poras\u2019 friend argued with the bouncer and the argument turned physical. Someone else at the club came to help the bouncer and tried to de-escalate the situation. Porras was reportedly heard by witnesses saying he was going to get a gun from his car and left the scene.<\/p>\n

Police said Porras returned with a gun in hand and after a scuffle, the patron drew his own gun and both he and Porras reportedly shot at each other, resulting in several people being hit.<\/p>\n

The patron left the scene but later turned himself in to the custody of the police.<\/p><\/blockquote>\n
