Surveillance video helped prove Florida man’s ‘stand your ground’ claim, attorney says<\/strong><\/p>\n

\nORANGE COUNTY, Fla. – A newly obtained video by FOX 35 News shows the moments before an August 2022 shooting that left a man dead and later led to the dismissal of a second-degree murder charge against the shooter.<\/p>\n

The shooting happened at the Heritage Hotel on Orange Blossom Trail in south Orange County.<\/p>\n

The video shows brothers Dylan Jimenez and Bryan Richardson walking toward the building’s breezeway. Rafael Villaverde is standing nearby.<\/p>\n

According to court documents, Villaverde and Jimenez had a “brief verbal exchange” moments before Jimenez is seen turning around and firing.<\/p>\n

The video confirms Jimenez was the first to fire his gun, with Villaverde returning fire shortly after.<\/p>\n

In the judge’s dismissal letter, he wrote the state tried to argue Villaverde provoked Jimenez to shoot at him. Still, the judge wrote, “There is insufficient evidence in the record to show\u2026 this exchange somehow provoked the use of force by Mr. Jimenez against [Villaverde].”<\/p>\n

Florida Gulf Coast University (FGCU) professor of forensic studies and former officer David Thomas agrees.<\/p>\n

“When you think about \u2018stand your ground,’ it’s not the before. It is the position that the person is in at that point in time if they feared for their life and if what they did was to stop an immediate attack upon them,” he said.<\/p><\/blockquote>\n

SAN ANTONIO \u2014 A man was shot and killed by police after he tried to take a gun away from a park police officer Sunday morning on the west side, according to SAPD Chief William McManus.<\/p>\n

The incident occurred on the 3400 block of Buena Vista Street around 8:30 a.m. Sunday.<\/p>\n

Chief McManus said a call for a disturbance came between a man, later identified as 27-year-old Ray Garcia, and a woman who are reportedly a couple and were at the park.<\/p>\n

When officers arrived, Garcia ran and jumped into a backyard of a nearby neighborhood. When an officer identified as Mark DeLaCruz, caught up to him a struggle began while trying to arrest him, SAPD said.<\/p>\n

Chief McManus said a second officer, identified as Juan Cardona, came to assist. The two officers tried to tase Garcia, but were unsuccessful. Authorities say Garcia then tried to take a gun from DeLaCruz, which is when Cardona shot and killed him, according to McManus.<\/p><\/blockquote>\n
