Michelle Lujan Grisham has declared gun violence and drug abuse a public health emergency after a string of recent deadly shootings, some involving children.<\/p>\n<p>The emergency order includes the suspension of open and concealed carry laws in Albuquerque and Bernalillo County, temporarily banning the carrying of guns on public property with certain exceptions, according to a statement from Lujan Grisham on Friday.<\/p>\n<p>Lujan Grisham cited the shooting deaths of three children from July through September, as well as a pair of mass shootings in the state.<\/p>\n<p>\u201cThe time for standard measures has passed,\u201d said Lujan Grisham, a Democrat. \u201cAnd when New Mexicans are afraid to be in crowds, to take their kids to school, to leave a baseball game \u2013 when their very right to exist is threatened by the prospect of violence at every turn \u2013 something is very wrong.\u201d<br \/>\n~~~~~~~~~~~~~~~~~~~~~~~<br \/>\nLaw enforcement in Albuquerque and Bernalillo County are pushing back against the order \u2013 even as they agree gun violence has gotten extreme.<\/p>\n<p>\u201cWhile I understand and appreciate the urgency, the temporary ban challenges the foundation of our Constitution, which I swore an oath to uphold,\u201d Bernalillo County Sheriff John Allen said in a statement.<\/p><\/blockquote>\n<p><a href=\"https:\/\/www.cnn.com\/2023\/09\/09\/us\/new-mexico-gun-violence-emergency\/index.html\">CNN<\/a><\/p>\n<p>When pressed by reporters she retorted, &#8220;No constitutional right, in my view, including my oath, is intended to be absolute.&#8221;<\/p>\n<p>I&#8217;ve checked and I cannot find where the Governor of New Mexico gets to rescind constitutional rights during a health crisis, or any other. To their credit LEOs in Albuquerque and Bernalillo Counties will flat not enforce the ban or have expressed deep concerns about the constitutional issues raised. Lawsuits will be falling like autumn leaves starting tomorrow.
