Back in November of ’21, Federal Employees with natural COVID immunity filed a class action lawsuit against Joe’s Executive Order (EO) requiring all feds to get the jab. Fauci and other members of the so-called Safer Federal Workforce Task Force were included in the lawsuit.<\/p>\n

The suit contended that the vaccine mandate violates employees\u2019 constitutional rights to bodily integrity and to decline medical treatment, and their statutory right to withhold informed consent. This finds an individual can only legally consent to something, an occurrence or act, if that person has been informed of and understands facts such as risks, benefits, and alternatives.<\/p>\n

The case further contends that the mandatory vaccine condition of their employment is medically unnecessary, as proven by the plaintiff’s SARS-CoV-2 antibody test results.<\/p>\n

The 5th U.S. Circuit Court of Appeals agreed with the plaintiffs.<\/p>\n

President Biden’s COVID-19 vaccine mandate for federal employees was blocked Thursday in federal appeals court. <\/p>\n

The 5th U.S. Circuit Court of Appeals in New Orleans reversed a ruling by a three-judge panel of the same court that had upheld the vaccination requirement. At a rare en banc rehearing, the full court rejected the government’s argument that courts don’t have jurisdiction over pre-enforcement challenges to Biden’s vaccine mandate. <\/p>\n

The effect of the court’s decision is to uphold a preliminary injunction issued by a federal judge in January 2022 that blocked the mandate. At the time, the Biden administration said nearly 98% of covered employees had already been vaccinated. <\/p>\n

The full 5th Circuit concluded that federal employees could take their case to court because they were challenging Biden’s authority on constitutional grounds. The court upheld the preliminary injunction blocking the vaccine mandate and now the federal employees’ case will proceed in district court.<\/p><\/blockquote>\n

Add the Federal Jab Mandate to the ever-growing list of Biden legal losses. Mandatory jabs for private employers and healthcare workers have already been blocked in various Federal courts. Other diktats been found legally wanting or are in the system including the bizarre eviction moratorium and student loan forgiveness.<\/p>\n
