The Protect Illinois Communities Act assault weapons ban was signed into law by Governor JB Pritzker as promised. The sweeping ban is reminiscent of the problematic 1994 Federal Assault Weapon Ban, and was almost immediately challenged in the courts.<\/p>\n
An Ilinois Effingham County judge placed a temporary block on the ban, based on a lawsuit arguing the ban violated the state constitution\u2019s due process and equal protection clauses. Judge Joshua Morrison agreed and ruled \u201cThe Court finds the Plaintiffs have shown a likelihood of success in relation to the equal protection clause of the Illinois Constitution.\u201d <\/p>\n

By Greg Bishop<\/strong><\/p>\n Three federal lawsuits against Illinois\u2019 gun ban made some movement Monday as a federal judge ordered a response from the state to show \u201ceach and every item banned.\u201d<\/p>\n In the Southern District of Illinois, four cases are pending. One is from the Federal Firearms Licensees of Illinois. Plaintiffs in that case filed a motion for preliminary injunction last week.<\/p>\n In three other cases, federal Judge Stephen McGlynn ordered state defendants to provide \u201cillustrative examples of each and every item banned\u201d under state law.<\/p>\n Thomas Maag, who brought the state level Crawford County case that was transferred to federal court, said the judge’s order will make it difficult for the state to comply.<\/p>\n \u201cBecause the ban is so all encompassing and uses a great many vague terms that I\u2019m not even sure that exactly what is banned and that\u2019s probably why judge McGlynn ordered the state to do that so that we could find out what exactly we are arguing about,\u201d Maag told The Center Square on Monday.<\/p><\/blockquote>\n
