Man accepts plea deal in federal court after lying about being Navy SEAL to secure loan<\/strong><\/a>

A Lexington man who lied about being a Navy SEAL and put false information on loan documents in order to start a horse business has accepted a plea deal in federal court.<\/p>\n

Christopher \u201cRusty\u201d Custer accepted a plea deal on Oct. 31 in United States District Court Eastern District, and pleaded guilty to one charge of bank fraud, according to court documents. Custer originally faced four charges including two counts of bank fraud, and two counts of wire fraud.<\/p>\n

The indictment said Custer \u201cfalsely purported\u201d to be a Navy SEAL in 2018 when he applied for a loan from Traditional Bank to buy a home and land in Lexington for an equine business.<\/p>\n

Custer allegedly misrepresented his \u201cfinances, character and personal history\u201d in documents he gave the bank in\u00a0May 2018\u00a0and\u00a0August 2019, the indictment said. He also is charged with sending false information about his financial status by email to an investor in\u00a0November 2019\u00a0to get a loan for an oil and gas pipeline inspection business.<\/p>\n

State records show a person with the same name set up a business called\u00a0Moon Dance Farm\u00a0in Lexington in\u00a0February 2018. It was dissolved in\u00a0October 2019\u00a0for not filing an annual report.<\/p>\n

Custer set up another business called\u00a0Wildcat Field Services LLC\u00a0in\u00a0October 2019. It was dissolved a year later after not filing an annual report. The indictment includes a forfeiture count aimed at recovering\u00a0$1,572,697\u00a0that Custer allegedly received as a result of fraud. However, the plea agreement agrees up on a money forfeiture of\u00a0$309,103.36\u00a0which Custer agreed was an accurate representation of the proceeds he obtained as a result of his alleged crimes.<\/p>\n

He faces up to 30 years in prison, a fine of not more than\u00a0$1 million, and a term of supervised release of up to five years.<\/p>\n
