“My body, my choice…unless it is a vaccination.”<\/p>\n

A\u00a0 NY State Supreme Court judge has ruled that the city must follow an earlier Staten Island court judge’s decision to reinstate city workers who refused to get Covid vaccinations, and has added that the fired workers should also get back pay for the period in which they didn’t work.<\/p>\n

In a ruling Monday, Judge Ralph Porzio wrote, “There is nothing in the record to support the rationality of keeping a vaccination mandate for public employees, while vacating the mandate for private sector employees or creating a carveout for certain professions, like athletes, artists and performers. This is clearly an arbitrary and capricious action because we are dealing with identical unvaccinated people being treated differently by the same administrative agency.”<\/span><\/span><\/p><\/blockquote>\n

Exemption attorney Christina Martinez also joined Todd Piro<\/a> in-studio to assess the dustup over unvaccinated rehires, calling out the city’s lawless refusal to comply with a court ruling while lambasting its alleged power grab.<\/p>\n

“They’re just refusing to comply and this isn’t the first decision that has ruled that they are exceeding their authority in mandating a vaccine for city workers,” Martinez said.<\/p>\n

“The city has continuously refused to comply with these decisions, with the court orders, and they’re appealing. Now we have to fight it out\u2026”<\/p><\/blockquote>\n

NYC, as is their wont, is appealing the court’s decisions (again!) and meanwhile is refusing to obey the court order. Remember when Mayor Eric Adams ran as a support-the-police-and-the-law candidate? Me too. Apparently there is a codicil of “unless I don’t like it”.<\/p>\n

One would hope that the attorneys for all those service members getting released for not wanting to get vaxxed are following this. The situations are not the same, but precedent is being set.<\/p>\n","protected":false},"excerpt":{"rendered":"
