Lawsuit from Navy good Samaritan shot amid police standoff will go to trial<\/strong><\/p>\n

\nA federal judge has declined to dismiss a civil-rights lawsuit from a former U.S. Navy master chief who was shot while trying to help Island County deputies subdue an armed and suicidal sailor following an 2017 armed standoff.<\/p>\n

Heath Garcia was shot in the foot with a high-powered rifle slung across the back of a deputy trying to arrest one of Garcia’s shipmates, Nicholas Perkins, who was drunk, suicidal and had barricaded himself in his house with several weapons, including a fully automatic M4 rifle.<\/p>\n

The lawsuit alleges the Island County Sheriff’s Office, Deputy Robert Mirabal and Lt. Michael Hawley, the scene commander, were responsible for a “state-created danger” and placed Garcia’s life at risk by allowing him to enter the house unarmed to try to talk to Perkins, while numerous heavily armed deputies huddled behind cover outside.<\/p>\n

U.S. District Judge Thomas Zilly denied Island County’s motion for summary judgment, saying there were factual disputes only a jury could settle.<\/p>\n

The lawsuit alleges Garcia persuaded Perkins to give himself up, led him out the front door and then grabbed him in a bear hug, shouting for deputies to help him detain the struggling Perkins, who was armed with a shotgun. That’s when Mirabal jumped into the fray, a loaded and charged AR-15 carbine slung across his back.<\/p><\/blockquote>\n

Investigators: Armed man shot, killed after breaking into Burke County home<\/strong><\/p>\n

\nInvestigators said a man shot and killed a home intruder early Friday morning in Burke County.<\/p>\n

Deputies responded to 2902 Flat Gap Road in Valdese after a report of shots fired around 3 a.m., according to a release from the Burke County Sheriff\u2019s Office.<\/p>\n

When deputies arrived at the scene, they found Howard Gene Cook, 37, dead at the scene, the release said.<\/p>\n

Authorities said Cook had broken into the home and got hold of a gun there.<\/p>\n

Cook pointed the gun at the homeowner, who also was armed, and the homeowner fired his weapon and hit Cook, the release said.<\/p><\/blockquote>\n

Yakima bar patron fatally shot man out of self-defense, release by police<\/strong><\/p>\n

Hours after fatally shooting a 26-year-old man outside of a bar, the subject was released as Yakima police investigators found substantial evidence to suggest he acted out of self-defense.<\/p>\n

According to a release issued by the Yakima Police Department, officers were dispatched to a bar on the 1100-block of S 3rd St for reports of a fight. Callers reportedly told 911 dispatchers that someone had been shot in the confrontation.<\/p>\n

Upon arrival, police and medics made contact with the 26-year-old male victim, whose identity has not been made public at this stage of the investigation. They confirmed that he later died from his gunshot wounds.<\/p>\n

Early into the investigation, Yakima police officers identified their suspects and tracked them down in a vehicle around midnight. These individuals were brought into custody for questioning while evidence, including surveillance footage, eyewitness accounts and other clues, were gathered by officers.<\/p>\n

After consulting with the Yakima Prosecutor, these subjects were released back to the public as their evidence suggested the victim was shot out of self-defense.<\/p><\/blockquote>\n
