Ross: King County court brings self defense to new level in downtown-shooting judgment<\/strong><\/p>\n

\nYesterday in King County Superior Court, a jury found Marquise Tolbert not guilty of murder. According to the Seattle Times, he was so relieved he burst into tears and embraced his defense lawyers.<\/p>\n

When I read the story, I, too, felt like bursting into tears, but for a different reason.<\/p>\n

Here\u2019s what happened: In January 2020, Tolbert and a friend \u2013 packing guns \u2013 had gone to Seattle\u2019s most notorious intersection \u2013 3rd and Pine \u2013 to target a rival gang member.<\/p>\n

This guy also had a gun and threatened them with it. So Tolbert and Tolliver decided to run.<\/p>\n

And as their pursuer fired at them, they fired back over their shoulders.<\/p>\n

Tolbert fired 10 rounds; his friend fired nine. Unfortunately, there were also a lot of other people downtown. And during the course of that six-second gunbattle \u2013 six bystanders were shot by Tolbert and Tolliver. A woman in a wheelchair was shot three times in the abdomen. She went through 15 surgeries and now wears a colostomy bag. A 9-year-old walking with his family had his femur fractured. And Tanya Jackson, age 50, who had been crossing Third Avenue, collapsed outside the McDonald\u2019s, and died from a gunshot wound.<\/p>\n

And yesterday, the jury decided that, because Tolbert was firing in self-defense, he was not criminally responsible for the death of the woman crossing the street, or any of the other injuries.<\/p><\/blockquote>\n

\nA family member who opened fire toward shooters who wounded his 17-year-old cousin on the city\u2019s Lower West Side provided a clearer picture of the events that led up to the attack.<\/p>\n

The 21-year-old man, who did not wish to be identified, said he and his family were celebrating a relative\u2019s birthday Tuesday night along the 1800 block of W. 21st Place.<\/p>\n

\u201cIt was my grandmother\u2019s birthday,\u201d he said.<\/p>\n

Some of the relatives had gone to the alley at the back of the house to check out another cousin\u2019s new car.<\/p>\n

Then the family heard what they thought were firecrackers.<\/p>\n

\u201cI see my cousin\u2019s face turn weird and I look to the right and see two gunmen at the end of the alley,\u201d he said.<\/p>\n

The family member said bullets started hurling toward them.<\/p>\n

\u201cWe start hearing [whizzing sound] and then the light post starting making all these weird noises, so we\u2019re like, \u2018oh, this is serious,’\u201d the man said.<\/p>\n

The man, a concealed carry license holder, pulled out his gun.<\/p>\n

\u201cI started shooting,\u201d he said. \u201cI stood my ground. I didn\u2019t even move. I stood my ground to defend my family.\u201d<\/p><\/blockquote>\n
