Prosecutor Brusic says he’s looking into shooting of alleged burglary suspect<\/strong><\/p>\n

\nYakima County Prosecuting Attorney Joe Brusic is looking into the recent shooting of a fleeing burglary suspect.<\/p>\n

The 24-year-old male suspect suffered a gunshot wound to the back of his head after allegedly burglarizing a warehouse early Tuesday morning in the 12000 block of Occidental Road in West Valley.<\/p>\n

The suspect told Yakima County Sheriff\u2019s deputies that property owners shot at him as he drove around them, with one round striking him in the back of his head and others striking the window and tires, according to a probable cause affidavit by deputies.<\/p>\n

\u201cIt\u2019s a strange set of facts and I\u2019m going to look into it,\u201d Brusic said Friday.<\/p><\/blockquote>\n

MAN WHO LOST GUN RIGHTS OVER NONVIOLENT MISDEMEANOR APPEALS TO SUPREME COURT<\/strong><\/p>\n

The question posed to the U.S. Supreme Court is if a lifetime firearms ban based on a nonviolent misdemeanor conviction violates the Second Amendment.<\/p>\n

The vehicle for the question comes in a petition filed with the nation’s high court over the case of Raymond Holloway, Jr by the Firearms Policy Coalition on Thursday.<\/p>\n

In 2005, Holloway pleaded guilty to a DUI charge in Pennsylvania — a first-degree misdemeanor which could have carried as much as five years in prison– although Holloway was only sentenced to the mandatory minimum of 90 days in a work-release program. In the past 15 years, he completed a psychology degree, worked as an educator, and hasn’t had any further problems with either alcohol or the law. <\/p>\n

However, he has a lifetime ban under federal law on the legal possession of firearms. That is the problem his case seeks to address with the court. <\/p>\n

\u201cMr. Holloway is but one example of a non-violent individual who has been barred from exercising his Second Amendment Rights for life through Congress\u2019s expansion of individuals who are deemed to be \u2018prohibited persons\u2019,\u201d explained FPC\u2019s Adam Kraut, an attorney who is on the case. \u201cHowever, the total bar on Mr. Holloway, and others like him, only stands when the lower courts ignore the Supreme Court\u2019s edict that Second Amendment challenges are to be evaluated through the Amendment\u2019s text as informed by history and tradition.” <\/p><\/blockquote>\n

Not exactly a feel good story, Delta Whiskies and Wiskettes, but an important issue on gun rights. Should a former felon, having served punishment for non-violent offences, be allowed to retain Constitutional Rights, specifically those under the Second Amendment? I have my opinion on the matter; I’m sure y’all do too.<\/p>\n
