VERNON DEEMED SELF-DEFENSE<\/strong><\/p>\n<blockquote><p>JEFFERSON COUNTY \u2014 A 58-year-old man has been released without charge from the Jefferson County Jail, after being arrested in connection with a Wednesday stabbing death that has been deemed self-defense.<\/p>\n<p>According to Jefferson County State\u2019s Attorney Sean Featherstun, after reviewing the evidence relating to the stabbing death of 53-year-old Mt. Vernon resident Kevin Foulks, he declined to file formal criminal charges against George Rush.<\/p>\n<p>\u201cMr. Rush and only the other cooperative witness in this case gave accounts which, if true, legally justify Mr. Rush\u2019s actions based upon established legal principles of self-defense,\u201d explained Featherstun, \u201cBoth witnesses told detectives Mr. Foulks was an acquaintance known to them who was aggressively pursuing Mr. Rush with a board he intended to use as a weapon. The physical evidence at the scene corroborates their account.\u201d<\/p>\n<p>Featherstun added that Foulks was able to speak with police but stated he was stabbed by an unknown person. No other material information was provided.<\/p>\n<p>\u201cAll other potential witnesses refused to talk to police, and there is simply no evidence to put forward which would rebut the self-defense claim. The homeowner shot through the door and injured one person.<\/p>\n<p>James said he\u2019s lived in Lubbock his whole life and since moving to the duplex in September 2019, last night\u2019s invasion wasn\u2019t the first time someone has tired to gain entry to his home.<\/p>\n<p>\u201cI\u2019ve had two so far,&#8221; said James. &#8220;One of them (happened) the second day after I got here. Somebody tried to get in. A couple of days later somBy: ebody came in and tried to get in with a key. Then when they found out someone was here they said they had the wrong apartment.\u201d<\/p>\n<p>James is in hospice care and is legally blind. He said someone started kicking down his door last night.<\/p>\n<p>\u201cAnd then, all of the sudden, BLAM and I said, \u2018what the hell?\u2019 And I ran and grabbed my gun and then just WHAM they hit it again. And the door flew open and I started shooting,\u201d said James.<\/p>\n<p>James told police that if he did not grab his gun there is no telling what the intruder could have done. Springs &#8216;make my day&#8217; killing<\/strong><\/p>\n<blockquote><p>By: Michael Karlik<br \/>\nA man who killed a homeless intruder in his apartment building is entitled to immunity under the law that allows for deadly force in the face of perceived threats, the Colorado Court of Appeals ruled on Thursday.<\/p>\n<p>Colorado\u2019s <a href=\"https:\/\/law.justia.com\/codes\/colorado\/2016\/title-18\/article-1\/part-7\/section-18-1-704.5\/\">&#8220;make my day&#8221; statute<\/a> permits the occupant of a dwelling to use deadly force against someone who unlawfully enters if they are committing \u2014 or intend to commit \u2014 a crime. The resident is immune from civil or criminal liability if he or she \u201creasonably believes that such other person might use any physical force, no matter how slight.\u201d<\/p>\n<p>Patrick Rau and his girlfriend lived in a multi-unit building in Colorado Springs. In January 2017, Rau\u2019s girlfriend noticed that the basement door was open and told him that a homeless man may be inside. Rau took his gun and a light to the basement, where he found a sleeping Donald Russell.<\/p>\n<p>After Rau nudged him awake, Russell became belligerent \u2014 throwing objects around the room. Rau said he would \u201ccount to five\u201d and then shoot if Russell did not leave. Rau followed through and fatally shot him.<\/p>\n<p>Prosecutors charged Rau with second degree murder, but he sought immunity under the \u201cmake my day\u201d provision.
