  • Illegals a law unto themselves in California cop-killing case

illegal alien familyThe family of Gustavo Perez Arriaga, a 32-year-old illegal alien, helped him evade police and attempted to help smuggle him across the United States-Mexico border after he allegedly murdered 33-year-old Newman, California, police officer Ronil Singh, federal documents allege.

Here’s a compound article from our very own Poetrooper. The first part is an American Thinker article by Monica Showalter, and she refers to a Breitbart article, and then continues with her own. Without further ado:

As the killing of a Newman, Calif. police officer demonstrates, illegal immigration is hardly a single crime.

    Breitbart News Reports
    By: John Binder

The family of Gustavo Perez Arriaga, a 32-year-old illegal alien, helped him evade police and attempted to help smuggle him across the United States-Mexico border after he allegedly murdered 33-year-old Newman, California, police officer Ronil Singh, federal documents allege.

The day after Christmas, Singh pulled Arriaga over on suspicion of drunk driving. That’s when police say the illegal alien shot Singh. Over his police radio, Singh called out “shots fired,” and as police arrived at the scene of the traffic stop, they found the officer with a gunshot wound.

Singh was transported to a nearby hospital, where he later died, leaving behind his wife Anamika and their newborn five-month-old son.

The Breitbart report, citing police sources, shows that seven family members of this alleged shooter were right there at the ready to help him evade any responsibility for his actions, and there was a human-smuggler there to help, too. It seemed to happen like clockwork. One might have helped him steal the gun from Washington State and apparently lied to the cops about it; another allegedly covered up a bullet hole in Arriaga’s pickup that was left there after the murder; one packed three changes of clothing for the alleged cop-killer so as to escape in comfort; one drove him to a relative’s house in Stockton so as to wait the matter out (apparently, they were thrown out by some relatives who wanted no truck with the law, though I don’t see any evidence they called the cops); one disposed of the murder weapon; one transported the alleged cop-killer elsewhere; one tricked a relative into a loan for the getaway, via the human-smuggler who got the whole group into the U.S. in the first place; one bought him a new cell phone; one brought a new change of clothes; and someone wired five hundred bucks for the escape.

All this in the course of Arriaga’s two days on the run. Supposedly, he’s a gang member, but the evidence here suggests that his gang is his family. And surprise, surprise: This group that acted with such military precision is all here illegally.

These are the people the media idolizes with sob stories in their bid to ensure open borders. These are the people House speaker Nancy Pelosi waxes poetic about regarding their “souls.” These are the people leftist judges refuse to sentence on account of the potential for their being deported afterward, creating one set of laws for Americans and another for foreigners. These are the people Democrats would like to have citizenship with voting rights, as well as hand out free health care to in California itself.

Poe had some rhetorical questions in his e-mail about prison, deportation, and the family’s children. My short answer is, if the parents are deported, easy. Take them with, and goodbye. If the parents are convicted they go to jail, and the kids can either go live with legal relatives on this side of the border, if any, or sent to their country of origin and let the authorities there sort it out.

And of course it’s Trump’s fault.

California man, previously deported in 2014, goes on 24-hour ‘reign of terror’ before dying in police chase
By Ryan Gaydos | Fox News

garciaCalifornia shooting spree suspect was deported in 2014. This undated photo provided by the Tulare County, Calif., Sheriff’s Office shows Gustavo Garcia. Central California authorities say Garcia, who went on a robbery, shooting and carjacking rampage, died Monday, Dec. 17, 2018, in a high-speed crash during which he intentionally tried to smash into other cars. (Tulare County Sheriff’s Office via AP)

A 36-year-old man who had been deported at least once and who owned a lengthy rap sheet died Monday after a day-long “reign of terror” in which he shot and killed someone, carjacked another person and led California police on a dangerous high-speed pursuit.

Gustavo Garcia, of Visalia, was pronounced dead at the scene of the crash on State Route 65 in Porterville when he was ejected from a stolen truck. Four others were injured, including one person who was in critical. Garcia, who was deported in 2014, had engaged in a gun battle with police and purposely tried to smash into other cars during the chase, officials said.

“We have one man that essentially [has] been on a personal reign of terror,” Tulare County Sheriff Mike Boudreaux said at a news conference.

Garcia has a lengthy criminal record that dates back to 2002, including charges for illegal firearm possession and meth, according to the Fresno Bee. Before his 2014 deportation, Garcia had three Immigration and Customs Enforcement violations. Boudreaux wouldn’t confirm Garcia’s immigration status at the time of his death or what country Garcia originated from.

Garcia’s rampage started at around 1 p.m. Sunday when he shot a farm worker who was in the middle of unpacking fruit in Exeter. The farm worker was expected to recover.

Moments later, Garcia robbed a convenience store with surveillance footage showing Garcia firing shots at the ceiling and demanding more than $2,000 in cash, according to the Fresno Bee. Police believe the shooting of the farm worker was meant to be a distraction for the robbery.

At 7:30 p.m., Garcia shot a Motel 6 guest in the arm and chest in Tulare, police said. Her wounds weren’t considered to be life-threatening.

“She had made eye contact with the subject and he had followed her to her parking spot, where he got out of the car and for an unbeknownst reason began firing at her vehicle,” Tulare interim Police Chief Matt Machado said.

At around 1:30 a.m. Monday, Garcia shot up a Shell gas station near Pixley and then killed Rocky Paul Jones, 51, about an hour later outside an Arco AMPM in Visalia, police Chief Jason Salazar said.

“It appears his rampage and his acts of violence were random and they were not chosen targets, which makes it even more dangerous,” Boudreaux said. “This person was targeting anyone who got in the way.”

He then fired shots from the backyard of his ex-girlfriend’s Visalia home as she and her children were inside. Police said the girlfriend and her children escaped unscathed.

Garcia fired shots into a home in the Sultana area and then crashed his car after a two-minute police chase during which he shot and hit pursuing sheriff’s cars and deputies fired back.

The kick in the gut? Garcia was arrested for a misdemeanor by the sheriff’s office and ICE put a detainer request on him. Garcia had a lengthy rap sheet, including being deported TWICE. But because of California’s new sanctuary city law, SB54, the sheriff’s office was unable to comply with the detainer request and had to release Garcia. Catch and release at its finest.

Robbery suspect shot, critically wounded at New Orleans East auto-parts store: NOPD
    By Laura McKnight

A robbery suspect was critically wounded when he was shot Friday night at a New Orleans East auto-parts store, New Orleans police confirmed.

Police responded just after 6 p.m. to a call of shots fired in the 9300 block of Chef Menteur Highway and arrived to find a robbery victim had shot a suspected robber, the NOPD said late Friday. The NOPD did not indicate whether the robbery victim is affiliated with the store.

Police on Saturday identified the suspect as 22-year-old Toney Brown. An update on Brown’s condition was not immediately available.

An ambulance picked up the wounded man and took him to a local hospital, according to New Orleans EMS spokesman Lt. Jonathan Fourcade.

Friday night, NOPD officers were investigating inside of the AutoZone Auto Parts in the 9300 block of Chef Menteur. One of the store’s glass front doors and a window were shattered from apparent bullet holes. Three lime-green evidence comes had been placed in front of the doorway. At least one more cone sat on the floor inside the store.

  • Cops and schools had no duty to shield students in Parkland shooting, says judge who tossed lawsuit

U.S. District Judge Beth Bloom ruled that the schools and sheriff aren’t responsible for people traumatized at Marjory Stoneman Douglas High School because the students weren’t in custody.

A federal judge says Broward schools and the Sheriff’s Office had no legal duty to protect students during the shooting at Marjory Stoneman Douglas High School.

U.S. District Judge Beth Bloom dismissed a suit filed by 15 students who claimed they were traumatized by the crisis in February. The suit named six defendants, including the Broward school district and the Broward Sheriff’s Office, as well as school deputy Scot Peterson and campus monitor Andrew Medina.

Bloom ruled that the two agencies had no constitutional duty to protect students who were not in custody.

“The claim arises from the actions of [shooter Nikolas] Cruz, a third party, and not a state actor,” she wrote in a ruling Dec. 12. “Thus, the critical question the Court analyzes is whether defendants had a constitutional duty to protect plaintiffs from the actions of Cruz.

“As previously stated, for such a duty to exist on the part of defendants, plaintiffs would have to be considered to be in custody” — for example, as prisoners or patients of a mental hospital, she wrote.

“His arbitrary and conscience-shocking actions and inactions directly and predictably caused children to die, get injured, and get traumatized,” the lawsuit claimed.

Medina knew Cruz and saw him arrive on campus, but did not confront him.

The lawsuit argued that the Sheriff’s Office and School Board “either have a policy that allows killers to walk through a school killing people without being stopped. Alternatively, they have such inadequate training that the individuals tasked with carrying out the polices … lack the basic fundamental understandings of what those policies are such that they are incapable of carrying them out.”

Metairie woman fatally shot Tulane law student husband in self-defense against abuse, JPSO says
    BY RAMON ANTONIO VARGAS

A woman fatally shot her husband as he beat her and tried to strangle her in a Metairie home Friday, the Jefferson Parish Sheriff’s Office said Saturday. Investigators did not book her with a crime after questioning her.

Jefferson Parish Coroner Gerry Cvitanovich identified the slain man as Ian Mastin, 27.

According to the Sheriff’s Office, Mastin’s 27-year-old wife called 911 just before 9 p.m. and reported she had shot her husband in their home in the 2900 block of Transcontinental Drive.

Responding deputies found Mastin had been shot multiple times. He died at the scene. Deputies took his wife into custody and brought her to the agency’s detective bureau to be interrogated.

The Sheriff’s Office said the woman cooperated with investigators and “provided a detailed and well-documented history of physical and psychological abuse” at the hands of Mastin.

Settlement reached in infamous ‘Norfolk Four’ case

Infamous ‘Norfolk Four’ sailors wrongly accused of a woman’s rape and murder are paid $4.9million in settlement 21 years after their conviction, following a campaign by novelist John Grisham

    • Four sailors were convicted in 1997 rape and killing of Michelle Moore-Bosko
    • Eric Wilson, Danial Williams, Joseph Dick and Derek Tice were later exonerated
    • The city of Norfolk has agreed to pay $4.9million to the sailors and the state agreed to pay $3.5million
    • DNA evidence linked another man, Omar Ballard, to the crimes
    • Three of the men were granted conditional pardons in 2009 but their convictions remained on the books
    • Wilson had failed to get his conviction overturned in court because he had already completed his sentence when he brought the challenge
    • The men have long said they confessed only after being intimidated by police

The city of Norfolk has agreed to pay $4.9million to four former sailors who were wrongly convicted of a woman’s rape and murder based on intimidating police interrogations. The state also has agreed to pay $3.5 million.

The payments close out a decades-long case that drew widespread attention as the men’s innocence claims were backed by dozens of former FBI agents, ex-prosecutors and crime novelist John Grisham.

‘These guys can now put all this behind them and try to recoup their lives,’ said Tony Troy, a lawyer who represented one of the sailors.

The men – Eric Wilson, Danial Williams, Joseph Dick and Derek Tice – were pardoned by then-Virginia Governor Terry McAuliffe last year of the 1997 rape and murder of Michelle Moore-Bosko.

Omar Ballard admitted sole responsibility for the killing and is serving a life sentence

I will not even pretend I can understand what those 4 men went through.  Nor can I imagine the emotional nightmare the loved ones of Michelle Moore-Bosko have been through.

  • Four Navy SEALs, Marine Raiders charged with killing Green Beret in Mali strangling

staff sgt melgarGreen Beret Staff Sgt. Logan Melgar

    Laura Widener

The U.S. Navy has charged four service members for the 2017 killing of Green Beret Staff Sgt. Logan Melgar.

Felony murder charges against two Navy SEALs and two Marine Raiders were announced Thursday, in addition to conspiracy, obstruction of justice, hazing and burglary charges, NBC News reported.

The four were accused of killing Melgar “while perpetrating a burglary,” according to the documents. They traveled to Marine quarters in June 2017 where they broke into Melgar’s room, awoke him from his sleep to restrain with him duct tape before holding him in a chokehold and strangling him.

A Naval Criminal Investigative Service (NCIS) investigation probed the death for more than a year, concluding just last week.

An Article 32 hearing will be held Dec. 10 in Norfolk, Virginia, before deciding to move the case to court-martial, CNN reported.

Melgar was found dead in shared Embassy housing on June 4, 2017. An autopsy revealed that he died by strangulation, a cause of death that was ruled a homicide.

The two SEALs charged with his murder were members of the elite SEAL Team Six.

The SEALs initially reported that they found Melgar “unresponsive” in their shared room, but later changed the story to say the three were wrestling.

They alleged to investigators that they fell down during the horseplay, and when they stood back up, they realized Melgar was no longer breathing. Then the two SEALs performed CPR and attempted to open an airway in Melgar’s throat, but could not get him to breathe again.

Investigators later found that the two SEALs were stealing money intended for informants, a crime that Melgar may have learned of. Two sources alleged that the SEALs offered to let Melgar join in on the scheme, but he refused.

For those unfamiliar with the term, an Article 32 hearing is similar to a Grand Jury or a preliminary hearing in civilian law. The hearing establishes if there is sufficient evidence to proceed with a prosecution, and if so at what level.

Springfield homeowner stabs man who forced his way into the house

    …then it got all stabby.

    https://www.wkbn.com/news/local-news/police-say-intruder-stabbed-by-homeowner-in-springfield/1568680364

SPRINGFIELD TWP., Ohio (WKBN) – Police say a homeowner in Springfield Township stabbed an intruder who forced his way inside.

It started as a call about a burglary at the house on Springfield Road around 1 a.m. Friday.

911 caller: “There’s somebody trying to break into my house and he actually slashed the tires on my car.”

The caller said he knows the intruder.

Investigators said a husband and wife from Columbiana were fighting and the wife left with two children to go to her friend’s house in Springfield.

The husband, Kyle Wilkinson, followed her there. He faces trial for domestic violence next month.

911 caller: “His wife and kids are hiding here because she has a protection order against him and he’s here, like, trying to get them.”

“He slashed a set of tires for a car in the driveway, pushed a window air conditioning unit into the house, attempted to kick in the front door and also threw a large rock through the rear sliding window,” Det. Gus Lolakis said.

As the caller waited for police to get to the house, screaming can be heard in the background of the 911 call. Then the woman took the phone.

Woman: “We need an ambulance now.”

    Dispatcher: “OK, what’s going on?”

    Woman: “I don’t know, I don’t know. There’s blood, there’s blood.”

Dispatcher: “Did he get into the house?”

Woman: “Yes, he came in the house and he freakin’ attacked him.”

When the shouting stopped, the homeowner got back on the phone.

911 caller: “As the wife and kids were behind me and I had a knife for self-defense, and ended up stabbing him.”

When authorities got to the house, they found Wilkinson bleeding from a stab wound but no one else had been hurt. Police said Wilkinson was armed as well.

The group entered the apartment and threatened the resident. From there, a physical altercation ensued.

The resident of the apartment cut one of the five subjects with a knife in what appeared to be an act of self-defense, according to Lt. John Trimble.
